After discussion, it was moved by Councilman Herlihy, and seconded by Council- woman LeClaire, to deny the application of Graham-Hitch Mortuary for General Plan amendment for that 2.1 acre parcel of land lying immediately northwesterly of the intersection of Hopyard Road and Valley Trails Drive South. The roll call vote was as follows: AYES: Councilmen Herlihy, Kinney, Councilwoman LeClaire, Councilman Philcox, and Mayor Mori NOES: None ABSENT: None It was moved by Councilman Herlihy, and seconded by Councilman Kinney, that Resolution Noo 74-122, requesting the Planning Commission to initiate zoning studies for the entire area surrounding Hopyard Road and Valley Trails Drive South, be adopted. The roll call vote was as follows: AYES: Councilmen Herlihy, Kinney, Councilwoman LeClaire, Councilman Philcox, and Mayor Mori NOES: None ABSENT: None Mayor Mori recessed the meeting at 9:50 P.M. MATTERS CONTINUED FOR DECISION Presentation by Hank Cupples~ Re: Holdin~ Tank Agreement Mr. Hank Cupples, representing Valley Realty, stated he addressed the City Council on May 13, 1974, regarding the Northwest corner of the Western Sierra property located at Valley Avenue and Santa Rita Road relative to the holding tank agreement. At that time he suggested a change in the wording in paragraphs 6 and 7 of the Agreement that would be agreeable to his proposed tenant and lend- ing institution for development of this property. Mr. Cupples stated he had met with the City Attorney but was still not satisfied with the verbage of paragraph 7. After lengthy discussion, it was moved by Councilman Herlihy, and seconded by Councilman Kinney, authorizing the Mayor to execute the Agreement between City and Henry Cuppies fo~ Holding Tank, subject to working out the details of the disputed section of the Agreement with the City Attorney.
