REPORTS OF THE CITY ATTORNEY <br />Report~ Re: Ray Street Alignment and Signalization <br /> Mro Scheidig presented his report regarding this matter, stating that it is <br />necessary for the City Council to adopt a resolution of intention to exercise <br />condemnation powers to acquire certain property for the purpose of Ray Street <br />realignment and signalization~ <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Herlihy, that <br />Resolution No. 74-17, a resolution of intention to exercise eminent domain powers <br />of the City of Pleasanton to acquire certain property owned by Mr. Falph F. Souza, <br />generally located at the corner of First and Ray Streets, in Pleasanton, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br />Introduc.e Ordinance~ Re: Adding Article 3 to Chapter 9 (Water.)~ Title II (Zoning.. <br />and Development) of the Ordinance Code of the City of Pleasanton relating to Well <br />Standards <br /> Mro Scheidig stated it is necessary for the City Council to introduce an ordt- <br />nance adopting well standards in order to comply with California Water Code, Section <br />18 and Resolution No. 73-7 of the California Regional Water Quality Control Board <br />relating to well standards in Alameda County. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Mori, that Ordi- <br />nance No~ 720, to be read by title only and waive further reading thereof, adding <br />Article 3 to Chapter 9 (Water), Title II (Zoning and Development), of the Ordinance <br />Code of the City of Pleasanton, relating to well standards, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br />Report~ Re: Reimbursement Agreement regarding Kaiser Water Line <br />Mr. Sooby presented the staff report regarding this matter, stating that Kaiser <br />Sand and Gravel had paid for installation of a 20" water line in Valley Avenue, and <br />it is now in order to execute a Reimbursement Agreement in the amount of $63,300.00 <br />to be paid over a period of eight years by the City. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Herlihy, authorizing <br />the appropriate City officials to execute a Reimbursement Agreement between Kaiser <br />Sand and Gravel and the City for reimbursement to Kaiser for construction of a 20" <br />water line on Valley Avenue. <br />The roll call vote was as ~llows: <br />AYES: Councilmen Herlihy, Kinney, Mori, and Reid <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Mayor Pearson <br /> <br /> Mayor Pearson stated his abstention was because of his affiliation with Kaiser. <br /> <br />Legislation <br /> Mr. Scheidig presented new legislation. <br /> <br /> It was moved by Councilman Mori, and seconded by Councilman Herlihy, authorizing <br />the City Attorney to contact the appropriate legislators in opposition to AB 819, <br />regarding overtime pay for police and fire personnel; and SB 629, regarding lease <br />purchase and joint exercise of powers financing; and also to urge support of AB 2119 <br />relating to the payment of workmens compensation benefits to retired safety personnel <br />for specified physical conditions. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br /> 5. 1/28/74 <br /> <br /> <br />
