Matters for the Information of the Council <br /> Mr~ Edgar presented a copy of his letter to the Commanding Officer at Camp <br />Parks, dated January 9, 1974, requesting street Eight-of-way regarding extension <br />of Stoneridge Dr~ve across 1-680. <br /> <br /> Mro Edgar presented a letter from William Parness, City Manager of Livermore, <br />to Bill Hein, BART, dated January 11, 1974, regarding feasibility of bus service <br />in the Valley. <br /> <br /> Mr. Edgar presented a bulletin from the League of California Cities regard- <br />ing E.P.A~ rescinding parking surcharge. <br /> <br /> Mr. Edgar presented report from Preserve Area Ridgeland Committee, dated <br />January 10, 1974, regarding Apperson Guest Ranch° <br /> <br /> Mr~ Edgar presented a report of the Citizens Advisory Committee - Livermore/ <br />Pleasanton BART Extension Board, dated January 14, 1974, regarding Local Action <br />for Transportation Improvements. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Approval of A~eement with William Apperson~ Re: Provision of Sewage Treatment <br />Service to Guest Ranch Development <br /> Mr. Scheidig presented his report regarding this matter. He indicated that <br />this agreement was the result of the direction given by the City Council to the <br />City Manager and City Attorney at its October 8, 1973, meeting. He stated that <br />by the terms of this agreement the City is obligated to undertake responsibility <br />with respect to planning, designing, construction, operation, maintenance and <br />repair of the facility and monitoring of the effluent generated by the facility, <br />and that the City is undertaking this obligation solely as an intermediary be- <br />tween the actual owner of the plant, Mr. Apperson, and the Regional Water Quality <br />Control Board. Mr. Apperson is required by the terms of the agreement to re- <br />imburse the City for all expenses incurred pertaining to the City's fulfillment <br />of its obligations and, if the City is required to obtain additional personnel, <br />Mr~ Apperson is required to reimburse the City for the cost of said personnel <br />even though said employees will be working on City projects during those times <br />that they are not required to supervise Mr. Apperson's facility. Mr. Scheidig <br />advised the Council that if they were desirous of assisting Mr. Apperson, this <br />agreement was the proper vehicle° <br /> <br /> Mr. Jim Jarnigan, 3262 Burgundy Drive, President of Vintage Hills Homeowners <br />Association, expressed the concern of his group of the City's consideration to <br />enter into this agreement in light of the sewer, problems within the City, and <br />questioned the benefits from this endeavor. <br /> <br /> Mro Frank Brandes, 6889 Corte Sonada, stated he was opposed to the City <br />entering into an agreement such as this because he felt it would be establish- <br />ing a dangerous precedent. <br /> <br /> Councilman Kinney stated we should look beyond our City limits and be con- <br />cerned with planning in the surrounding areas and cooperate with existing agencies <br />to help solve problems. <br /> <br /> Councilman Herlihy stated that in support of open space, this commercial <br />venture meets the requirements as a recreational facility and he was in favor <br />of <br /> <br /> Mayor Pearson stated we have all the sewage treatment responsibilities we <br />can handle and he felt the City should not assume obligation for a private <br />sewage treatment plant beyond its borders, and was opposed to this application. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Herlihy, that the <br />appropriate City officials be authorized to execute an agreement with Mr. William <br />Apperson and other individuals pertaining to the planning, construction, operation, <br />maintenance and repair, as well as monitoring, a sewage treatment facility to be <br />owned by Mr. William Apperson and others and located on property belonging to Mr. <br />William Apperson, commonly known as Diamond A Ranch. <br /> <br /> 6. 1/14/74 <br /> <br /> <br />
