P~ G~iffin, 1696 Orchard Way, expressed concerning regarding denial of <br /> his application by the Board of Adjustments for a patio cover which would encroach <br /> into the required side yard of his p=operty, stating that it would create a hard- <br /> ship for his family, they need the storage area, it would improve the aesthetic <br /> value for privacy and that his neighbors were not opposed to the construction of <br /> the patio cover, He presented pictures of the area in question, and urged City <br /> Council approval of his appeal~ <br /> <br /> Mayor Mori declared the public hearing closed. <br /> <br /> Mr. Scheidig cited a recent California Supreme Court decision relative to the <br /> granting of variances and indicated that if requests such as the present were <br /> granted the Council should give serious consideration to amending the Ordinance <br /> Code. <br /> <br /> After discussion, it was moved by Councilman Philcox, and seconded by Mayor <br /> Mori, that the appeal of W. P. Griffin of the Board of Adjustment decision to <br /> deny approval of an application for a Variance from the requirements of Section <br /> 2-5.35, Article 3, Chapter 2, Title II of the Ordinance Code of the City of <br /> Pleasanton to allow the construction of a patio cover which would encroach into <br /> the required side yard of property located at 1696 Orchard Way, subject property <br /> is in the R-1-6500 (Single Family) District, be denied. <br /> The roll call vote was as follows: <br /> AYES: Councilman Philcox and Mayor Mori <br /> NOES: Councilman Kinney and Councilwoman LeClaire <br /> ABSENT: Councilman Herlihy <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilwoman LeClaire, that <br /> the appeal of W. P. Griffin as written above be approved. <br /> The roll call vote was as follows: <br /> AYES: Councilman Kinney and Councilwoman LeClaire <br /> NOES: Councilman Philcox and Mayor Mori <br /> ABSENT: Councilman Herlihy <br /> <br /> Due to the 2-2 split vote no action was taken by the Council affecting the <br /> decision of the Board of Adjustment, thus the appealed decision remains in effect. <br /> <br /> Councilman Herlihy entered the meeting at 8:40 P.M. <br /> <br /> Ordinance amending Article 16~ Chapter 2~ Title II of the Ordinance Code of the <br /> Cit_Z' of Pleasantonz pertainin~ to Parkin~ Assessment Districts <br /> Mr. Scheidig presented his report dated October 18, 1974, regarding this <br /> matter, stating that it is necessary for the City Council to introduce an ordi- <br /> nance amending the Municipal Code to allow for different parking requirements <br /> for properties located within local improvement parking assessment districts. <br /> <br /> 10/30/74 <br /> <br /> <br />
