It was moved by Councilman Philcox, and seconded by Councilman Kinney, that Resolution No. 74-210, approving application of the Planning Commission for an amendment to the General Plan of the City of Pleasanton for that area bounded by Stanley Boulevard on the No~th, Main Street on the West, the Arroyo del Valle on the South, and the City Limits on the East, be adopted, designating the area West of the Trailer Park to Santa Rl, ta as C-8 and the area East and including the Trailer Park as C-F~ The roll call vote was as follows: AYES: Councilmen Kinney, Philcox, and Mayor Mori NOES: Councilwoman LeClaire "~ ABSENT: Councilman Herlihy Appeal of W. Mayor Mori declared the public hearing open. Mr. W. P~ G~iffin, 1696 Orchard Way, expressed concerning regarding denial of his application by the Board of Adjustments for a patio cover which would encroach into the required side yard of his p=operty, stating that it would create a hard- ship for his family, they need the storage area, it would improve the aesthetic value for privacy and that his neighbors were not opposed to the construction of the patio cover, He presented pictures of the area in question, and urged City Council approval of his appeal~ Mayor Mori declared the public hearing closed. Mr. Scheidig cited a recent California Supreme Court decision relative to the granting of variances and indicated that if requests such as the present were granted the Council should give serious consideration to amending the Ordinance Code. After discussion, it was moved by Councilman Philcox, and seconded by Mayor Mori, that the appeal of W. P. Griffin of the Board of Adjustment decision to deny approval of an application for a Variance from the requirements of Section 2-5.35, Article 3, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow the construction of a patio cover which would encroach into the required side yard of property located at 1696 Orchard Way, subject property is in the R-1-6500 (Single Family) District, be denied. The roll call vote was as follows: AYES: Councilman Philcox and Mayor Mori NOES: Councilman Kinney and Councilwoman LeClaire ABSENT: Councilman Herlihy It was moved by Councilman Kinney, and seconded by Councilwoman LeClaire, that the appeal of W. P. Griffin as written above be approved. The roll call vote was as follows: AYES: Councilman Kinney and Councilwoman LeClaire NOES: Councilman Philcox and Mayor Mori ABSENT: Councilman Herlihy Due to the 2-2 split vote no action was taken by the Council affecting the decision of the Board of Adjustment, thus the appealed decision remains in effect. Councilman Herlihy entered the meeting at 8:40 P.M. Ordinance amending Article 16~ Chapter 2~ Title II of the Ordinance Code of the Cit_Z' of Pleasantonz pertainin~ to Parkin~ Assessment Districts Mr. Scheidig presented his report dated October 18, 1974, regarding this matter, stating that it is necessary for the City Council to introduce an ordi- nance amending the Municipal Code to allow for different parking requirements for properties located within local improvement parking assessment districts. 10/30/74
