Approval. of Plans and Specifications~ arid authorization to go to bid on Woodthrush <br /> Park <br /> Mr. Sooby presented the staff report dated September 19, 1974, regarding this <br /> matter. <br /> <br /> Mr. Arc Whitehair, representing Toups Corporation, Consulting Engineers, <br /> presented plans for grading, drainage, irrigation and turfing of the 3.5 acre <br /> Woodthrush Park site in the Plea~anton Valley area. <br /> <br /> It was moved by Councilwoman LeClaire, and seconded by Councilman Philcox, <br /> approving plans and specifications for development of Woodthrush Park, and <br /> authorizing City staff to call for bids on this project. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Councilwoman LeClaire, Councilman Philcox, <br /> and Mayor Mori <br /> NOES: None <br /> ABSENT: None <br /> <br /> Report~ Re: Proposed Annexation of the Pleasanton Waste Disposal Site <br /> Mr. Edgar presented his report dated September 11, 1974, regarding this <br /> matter. <br /> <br /> Mr. Bill Hirst, representing Pleasanton Garbage Service, stated that this <br /> firm has attempted to meet the needs of the residents of the City of Pleasanton <br /> as efficiently and inexpensively as possible and to that end a transfer station/ <br /> recycling center on the existing landfill site has on several occasions been <br /> proposed by Pleasanton Garbage Service, Inc., and approved by the City of <br /> Pleasanton. He added that the County feels that since this property is close <br /> to the City Limits and within the City's Sphere of Influence and is a quasi- <br /> municipal use, that the matter should appropriately be dealt with by the City. <br /> He requested that the City of Pleasanton initiate proceedings to annex the <br /> property to the City. <br /> <br /> It was moved by Councilman Herlihy, and seconded by Councilman Philcox, <br />" authorizing the City staff to initiate annexation proceedings for that property <br /> described in Assessor's Map 946 and owned by Pleasanton Garbage Service, Inc., <br /> to file with the Local Agency Formation Commission. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Councilwoman LeClaire, Councilman Philcox, <br /> and Mayor Mori <br /> NOES: None <br /> ABSENT: None <br /> <br /> Matters for the Information of the Council <br /> Mr. Edgar presented his report dated September 20, 1974, regarding Pleasanton's <br /> position on Las Positas New Town, stating that if the Council desires to discuss <br /> the item further they can schedule this matter as a specific agenda item at a <br /> future Council meeting, or schedule this matter for special discussion at a <br /> Special Meeting of the City Council. <br /> <br /> Council concurred to review this matter at a Special Study Session on <br /> November 4, 1974, at which time additional information will be presented. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Legal Options Available to Municipa.1. type services in Unincorporated Areas <br /> Mr. Scheidig presented his report dated August 6, 1974, regarding this matter, <br /> stating the City Council, at their meeting of July 22, 1974, took action in support <br /> cf the establishment of a County service area where an unincorporated area is <br /> receiving municipal-type services, and requested that this office look into the <br /> possibility of having the City remove itself from any taxing area which involves <br /> municipal-type services to unincorporated areas. Government Code Section 25643 <br /> provides that a city having its own fire protection services may, prior to March <br /> 1 of any year, file with the Board of Supervisors a resolution declaring that <br /> tt~e city is providing fire protection services within its Jurisdiction and as a <br /> Yesnit, should not be assessed for the coming fiscal year and any year thereafter <br /> fcr any portion of the costs of county fire protection services rendered within <br /> the county. This resolution would pertain only to structural fire protection <br /> costs since the section specifically provides an exclusion for the costs of <br /> forest, range and grass fire protection. <br /> 6. 9/23/74 <br /> <br /> <br />
