The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Report~ Re: Al.location of 32 D.U.E.'s at Sunol Plant <br />Mr. Walker presented the staff report dated June 5, 1975, regarding this matter. <br />He stated the Postal Service today had applied for five sewer connections for their <br />new building. <br /> <br /> Mro John Edmands, representing the Chamber Industria~ D~e~opment Committee, <br />requested that the entire 32 D.U.E.'s be reserved for industry to get the City back <br />in a good climate for industrial development, and give the Committee a reserve of <br />sewer capacity to have available for potential industrial developers. <br /> <br /> Council discussion en'sued regarding appropriation of sewer allocation between <br />industrial, commercial, and residential. <br /> <br /> Councilmember Herlihy suggested that a sewer assessment district be looked <br />into by staff for the Stanley Boulevard properties presently on holding tanks, so <br />that these units could be provided with sewer service. <br /> <br /> Mayor Kinney recessed the meeting to a litigation Executive Session at ~|25 <br /> Mayor Kinney reconvened the meeting at 9:55 P.M. <br /> <br /> Mr. Scheidig explained a claim filed by H. C. Elliott relating to damages for <br />non-development of residential units in the Vintage Hills area would expire soon <br />and the Council's action would affect this potential suit. Mr. Scheidig explained <br />the annexation agreement upon which the Elliott Claim is based. <br /> <br /> Mayor Kinney informed Mr. Harry Elltort, Jr., that the City Council is desirous <br />to retain some connections for industrial-commercial usage and inquired what posi- <br />tion his company would take should Council ep!It the D.U.E.~s down the middle - <br />16/16. <br /> <br /> Mr. Harry Elliott, Jr., stated that as far as could be determined at this <br />point he would be willing to abide by the dictates of the City Council. He stated <br />that no suit would be filed if the City is acting reasonably to provide connections <br />to his company and he felt that the proposed split would be reasonable. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember McLain, <br />that Resolution No. 75-125, reserving sixteen (16) D.U.E. sewer connections for <br />commercial and industrial use for a six (6) month period, and allocating sixteen <br />(16) D.U.E. sewer connections to H. C. Elliott, Inc., be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Chair. <br /> <br />REPORTS OF THE CITY MANAGER (Contd.) <br />Report~ Re: Proposed Sewer Service Charge Increase <br /> Mr. Walker presented the staff report dated June 4, 1975, regarding this <br />matter, indicating that an increase was necessary due to an increase by V.C.S.D. - <br />the City's payments to V.C.S.D. would thus increase. <br /> <br /> After discussion, it was moved by Councilmember Philcox, and seconded by <br />Councilmember McLain, that Resolution No. 75-126, approving an increase in the <br />sewer service rate schedule of $1.00 per month for each residential unit with <br />proportionate increases for other users, and the increase of a surcharge to be <br />considered after a rate study is completed by City staff in approximately six <br />(6) months, be adopted. <br /> <br /> 4. 6/9/75 <br /> <br /> <br />
