<br /> C6de of the City of Pleasanton relating to permitted and conditional uses, be
<br /> introduced°

<br /> It was moved by Councilmember LeClaire, and seconded by Councilmember Herlthy,
<br /> that Resolution No, 75-195, to deny the application of the City Council for an
<br /> amendment to Section 2-7o08a, Article 8, Chapter 2, Title II of the Ordinance Code
<br /> of the City of Pleasanton, to allow picture framing shops as a permitted use in
<br /> the C-S (Commercial Service) District, be adopted.
<br /> The roll call vote was as £ollows:

<br /> NOES: Councilmember Philcox and Mayor Kinney

<br /> Appeal to the decision of the Board of Ad3ustment in d~yin~ the request of Dennis
<br /> Stuart for a variance to Section 2-5°35 of Article 3~ Chapter 2~ Title !I of the
<br /> Ordinance Code of the City of Pleasanto~ to allow the retention of a carport
<br />_ which encroaches into the required frontyard setback of property at 1536 Mendoza
<br /> Court~ zonin~ foE the propert7 being R-1-6500 (Single Family Residential) District
<br /> Mr. Harris presented his report dated September 2, 1975, regarding this matter.

<br /> Mayor Kinney declared the public hearing open.
<br />
<br /> Mr. Dennis Stuart stated he had made a mistake in measuring from the curb line
<br /> and didn't didcover the error until inspection of the completed carport structure.
<br /> He added the structure did not affect the health, safety, and welfare of the
<br /> neighborhood and, therefore, was not a nuisance° He presented a petition, signed
<br /> by all fifteen residents oE the Court, stating they did not object to the carport.
<br /> Mr, Stuart added that reconstruction of this structure would be very costly, and
<br /> requested approval of his variance°
<br />
<br /> No one in the audience spoke in opposition to the appeal.

<br /> Code of the City of Pleasanton, tc allow the retention of a carport which en-
<br /> croaches into the required frontyard setback of property at 1536 Mendoze Court;

<br /> Councilmember McLain suggested the timing of the building inspection on
<br /> structures such as carports be changed, in order to eliminate mistakes at the
<br /> beginning of a project, Mr, Edgar explained the inspection procedures used
<br /> by the City.
