13 i <br /> <br /> Appeal of Phillip Lum to a decision of the Board of Adjustment to deny request <br /> for a variance to Sectip~ 2-5°.35, Article 3, Chapter 2, Title II of the Ordinance <br /> Code .o~. th~ qit7 0~ Pl.eaSant.q~? to allow the construction of a pool cover at 4423 <br /> Bacon Court, which would encroach into the required rear yard and exceed the basic <br /> floor area limit for structures located within the zonel zonin~ for the property <br /> b.ein~ R-1-6500 (Single Family Residential) District <br /> Mr. Harris presented his report dated September 2, 1975, regarding this matter. <br /> <br /> Mayor Kinney declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this appeal. <br /> <br /> Mayor Kinney declared the public hearing closed. <br /> <br /> After discussion determining lack of hardship to the owner on this matter, it <br />was moved by Councilmember McLain, and seconded by Councilmember LoCiairs, that <br />Resolution No. 75-197, denying the appeal of Phillip Lum to a decision of the <br />Board of Adjustment to deny request for a variance to Section 2-5.35, Article 3, <br />Chapter 2, Title II of the Ordinance Code of the City of Pleasanton, to allow the <br />construction of a pool cover at 4423 Bacon Court, which would encroach into the <br />required rear yard and exceed the basic floor area limit for structures located <br />within the zone; zoning for the property being R-1-6500 (Single Family Residen- <br />tial) District, be adopted, <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LoCiairs, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters continued for decision presented at this meeting. <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting° <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no Report of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY MANAGER <br />Review of Bids and Awar~ of qpptract, Project No. 75-3, Ray Street Water Main <br />Installation <br /> Mr, Sooby presented his report dated September 5, 1975, regarding this matter. <br /> <br /> Councilmember Herlihy asked if bids could be awarded to local contractors. <br />Mr. Scheidig explained that by law bids must be awarded to the low bidder. <br /> <br /> It was moved by Councilmember Philcox, and seconded by Councilmember McLatn, <br />that the contract for the Ray Street Water Main Installation Project be awarded <br />to Bepco Company, Inco, 4901 Tidewater Avenue, Oakland, in the amount of <br />$16,520.00, and the appropriate City officials be authorized to sign the <br />agreement° <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Report~ Re: Sewer Plant <br />Mr. Edgar stated this item had been placed on the agenda in response to <br />citizen complaints regarding odor at the Sunol Blvdo Sewage Treatment Plant. <br /> <br /> Mr~ Campbell presented the report of the Director of Field Services dated <br />September 4, 1975, regarding this matter, and stated a report regarding <br />alternative solutions to the problem would be forthcoming soon. <br /> <br /> Councilmember Philcox stated that odors had been noticed near the Mocho <br />Station and he requested this be looked into. <br /> <br /> 9/8/75 <br /> <br /> <br />
