t23 <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Report, Re: COVA Bylaws, Joint Powers Agreement, and 1975-76 Budget <br /> Mr. Scheidig presented his report dated 3uly 23, 1975, regarding this matter, <br />and explaining the proposed amendments in the Joint Power Agreement. <br /> <br /> After discussion, it was moved by Councilmember McLain, and seconded by <br />Councilmember LoCiairs, that Resolution No. 75-182, approving the 3oint Powers <br />Agreement of COVA as amended, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, and Philcox <br />NOES: Mayor Kinney <br />ABSENT: None <br /> <br />Resolution Re: Extension of Time for Adoption of General Plan <br /> Mr. Scheidig presented his report dated August 20, 1975', regarding this <br />matter. <br /> <br /> It was moved by Councilmember McLain, and seconded by Councilmember LoCiairs, <br />that Resolution No. 75-183, requesting Council of Intergovernmental Relations <br />extension of time for adoption of General Plan due to an Environmental Impact <br />Report, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Legislation <br /> Mr. Scheidig presented the latest League of California Cities legislative <br />report, and requested Council direction. The Council authorized continued <br />opposition to AB 1352, AB 700 and AB 301. Council authorized continued sup- <br />port of AB 416, 1375, and SB 100. Council authorized opposition to SB 450, <br />and support of AB 1961. <br /> <br />Oral Report~ Re~ BART <br /> Mr. Scheidig stated that he had investigated Mayor Kinney's inquiry regard- <br />ing BART and found: <br /> <br />1. State monies have financed portions of BART's system - most notably the <br /> Transbay Tube. <br /> <br />2. Only Counties can withdraw from BART under present law. The act would <br /> have to be amended to allow cities to withdraw - such a bill was intro- <br /> duced last year and was unsuccessful. <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> Councilmember McLain reported that AB-2220 died in Assembly this date. <br /> <br />MATTERS INITIATED BY COUNCIL MEMBERS <br /> Councilmember Herlihy requested staff obtain a copy of Lone Star Gravel <br />Company's Environmental Impact Report, as he felt there were some errors in <br />this report which should be rebutted to. <br /> <br /> Councilmember Herlihy requested further information regarding the status <br />of the Volunteer Firemen negotiations. Council concurred to have staff come <br />back with a report on this matter on September 8, 1975. <br /> <br /> 5. 8/25/75 <br /> <br /> <br />
