t23 The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney NOES: None ABSENT: None REPORTS OF THE CITY ATTORNEY Report, Re: COVA Bylaws, Joint Powers Agreement, and 1975-76 Budget Mr. Scheidig presented his report dated 3uly 23, 1975, regarding this matter, and explaining the proposed amendments in the Joint Power Agreement. After discussion, it was moved by Councilmember McLain, and seconded by Councilmember LoCiairs, that Resolution No. 75-182, approving the 3oint Powers Agreement of COVA as amended, be adopted. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, McLain, and Philcox NOES: Mayor Kinney ABSENT: None Resolution Re: Extension of Time for Adoption of General Plan Mr. Scheidig presented his report dated August 20, 1975', regarding this matter. It was moved by Councilmember McLain, and seconded by Councilmember LoCiairs, that Resolution No. 75-183, requesting Council of Intergovernmental Relations extension of time for adoption of General Plan due to an Environmental Impact Report, be adopted. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney NOES: None ABSENT: None Legislation Mr. Scheidig presented the latest League of California Cities legislative report, and requested Council direction. The Council authorized continued opposition to AB 1352, AB 700 and AB 301. Council authorized continued sup- port of AB 416, 1375, and SB 100. Council authorized opposition to SB 450, and support of AB 1961. Oral Report~ Re~ BART Mr. Scheidig stated that he had investigated Mayor Kinney's inquiry regard- ing BART and found: 1. State monies have financed portions of BART's system - most notably the Transbay Tube. 2. Only Counties can withdraw from BART under present law. The act would have to be amended to allow cities to withdraw - such a bill was intro- duced last year and was unsuccessful. COMMUNICATIONS There were no Communications presented at this meeting. CITY COUNCIL COMMITTEE REPORTS Councilmember McLain reported that AB-2220 died in Assembly this date. MATTERS INITIATED BY COUNCIL MEMBERS Councilmember Herlihy requested staff obtain a copy of Lone Star Gravel Company's Environmental Impact Report, as he felt there were some errors in this report which should be rebutted to. Councilmember Herlihy requested further information regarding the status of the Volunteer Firemen negotiations. Council concurred to have staff come back with a report on this matter on September 8, 1975. 5. 8/25/75
