The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Application of the Plannin~ Commission to amend Section 2-7.08a~ Article 8~ <br />Chapter 2~ Title II of the Ordinance Code of the City of P!easant.0n~ to allow <br />carpet and floor covering stores as a permitted use in the C-C (Central Com- <br />mercial)~ C-S (Commercial Sery.ipe)~ and C-R (Regional Commercial) Districts <br /> Mr. Harris presented the staff report dated July 9, 1975, regarding this <br />matter. <br /> <br /> Mayor Kinney declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Kinney declared the public hearing closed. <br /> <br /> It was moved by Councilmember McLa'~n, and seconded by Councilmember Herlihy, <br />that Ordinance No. 765, to be read by title only and waiving further reading <br />thereof, amending Section 2-7.08a, Article 8, Chapter 2, Title II of the Ordi- <br />nance Code of the City of Pleasanton, to allow carpet and floor covering stores <br />as a permitted use in the C-C (Central Commercial), C-S (Commercial Service), <br />and C-R (Regional Commercial) Districts, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Appeal of Pleasanton Body Shop~ Alvin Bernard and Michael Garden~ from a <br />decision of the Planning Commission and Design Review Board in re~ard to <br />Condition 3 imposed with Design Review Application Z-75-83~ and Conditional <br />Use Permit Application UP-75-13~ said Condition 3 prohibits e~ress from the <br />site onto Vervais Avenue <br /> .Councilmember Philcox advised Council that as Director of First National <br />Bank of Pleasanton he was abstaining on this matter due to a potential con- <br />flict of interest. Mr. Philcox then left the Council Chambers and remained <br />absent during this entire item. <br /> <br /> Mr. Harris presented the staff report dated July 9, 1975, regarding this <br />matter. <br /> <br /> Mayor Kinney declared the public hearing open. <br /> <br /> Mr. William Hirst, Attorney, 147 Bernal Avenue, representing Pleasanton <br />Body Shop, presented reasons for requesting the appeal be granted. <br /> <br /> Mr. Dan Pons, 4242 Vervais Avenue, spoke in opposition to granting the <br />appeal. <br /> <br /> Mayor Kinney declared the public hearing closed. <br /> <br /> Councilmember LeClaire reiterated her concern regarding this commercial <br />zoning adjacent to a residential neighborhood, and the problems it has created. <br /> <br /> After discussion, it was moved by Councilmember LeClaire, and seconded by <br />Councilmember McLain, that Resolution No. 75-155, denying the appeal of <br />Pleasanton Body Shop, Alvin Bernard and Michael Garden, from a decision of <br />the Planning Commission and Design Review Board in regard to Condition 3 <br />imposed with Design Review Application Z-75-83, and Conditional Use Permit <br />Application UP-75-13, said Condition 3 prohibits egress from the site onto <br />Vervais Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Philcox <br /> <br /> 3. 7/14/75 <br /> <br /> <br />
