REPORTS OF THE CITY MANAGER <br />Report, Re: Allocation of 291 additional sewer connections a~..S~no.!..S~wage' <br />Treatment Plant <br /> Mr. Edgar explained that the Council will belooking at two documents <br />this evening, the Assistant City Manager's report on allocation of remaining <br />capacity at Sunol Treatment Plant, and the resolution establishing a <br />method for allocation, prepared by the City Attorney. <br /> <br /> Mr. Campbell presented his report dated April, 1976 for discussion. <br /> <br /> Councilmember Brandes had severe reservations regarding the regulation <br />of flow from ~he Fairgrounds and cited figures from a study entitled "In- <br />dustrial Waste Report" prepared by Kennedy Engineers in June 1975 which <br />he felt did not correspond with the figures cited in the report presented <br />for study tonight regarding B.O.D. loading from the Fairgrounds. <br /> <br /> Mr. Ted Erler, representing Kennedy Engineers, was present and indicated <br />that the earlier report was general in nature and looked at a variety of uses <br />within the City. The figures regarding B.O.D. in the present staff report were <br />the result of a specific analysis of just flows into and out of the sewer line <br />through the Fairgrounds. <br /> <br /> Mr. Brandes asked to see the documentation used regarding Fair flow <br />to the Sunol plant to back up Mr. Campbell's report. <br /> <br /> General Council discussion ensued and it was pointed out that the figures <br />in question had previously been shown to and made available to the Council <br />during a litigation session held on April 5, 1976. <br /> <br /> Mr. Scheidig reviewed his report and resolution setting parameters <br />for sewer permit allocations. <br /> <br /> Mayor Philcox recognized requests from members of the audience to <br />address the Council. <br /> <br /> Mr. Woody Pereira, representing Morrison Homes, suggested that Council <br />consider allocating 200 DUE's for the first two years, then declining to <br />100 DUE's per year for the next three years. He also suggested some <br />changes in the staff report since it is to be an Exhibit to the resolution; <br />that Morrison's allocation refer to Pleasanton Valley, rather than delin- <br />eating Creeks Bend or Woodthrush. <br /> <br /> Mr. Chuck Seymour, 492 San Gabriel Court, addressed the Council, stating <br />his concerns regarding the lack of City control over the amount of sewage <br />coming out of the Fairgrounds. He stated further that the Regional Board <br />would like to see attendance figures by the Fair. This, coupled with the <br />Fair's building plans for year-around use, is continually adding more flow <br />to the Sunol Plan~. <br /> <br /> Mr. Robert Pearson, 3590 Churchill Court, next addressed the Council. <br />He also expressed his concern regarding the Fair's sewage flow to the Sunol <br />Plant and objected to the fact that the Fair is protected from paying sewer <br />service charges by an agreement valid for the life of the plant. He felt <br />that the City should do whatever they have to do to see that the Fair Board <br />pay their fair share, even it is necessary for the contract to be litigated. <br /> <br /> Harry C. Elliott, Jr., representing H. C. Elliott, Inc., 47 Quail. Court, <br />Walnut Creek, spoke next, commending the City staff on compiling the figures <br />for the allocation system proposed. He, too, stated that his company would <br />like to see a larger percent allocated in the earlier years, but that the <br />only solution is final abandonment of the plant and the phasing into V.C.S.D. <br /> <br /> Mr. William G. Kovak, Weymouth Court, asked what alternative the City <br />had if a natural or unnatural disaster befell the Sunol Plant. <br /> <br /> Mayor Philcox outlined the City's plans to phase out the Sunol Plant. <br /> <br /> Mr. Dudley Frost, representing Morrison Homes, next addressed the <br />City Council expressing his desire for team effort in solving these pro- <br />blems and knowing where the City is heading in this regard. <br /> <br /> -5- 4-12-76 <br /> <br /> <br />
