The following persons spoke in favor of the appeal: <br /> <br /> Peter M. Turner, 1540 San Pablo Avenue, Oakland, Attorney representing <br /> Appellant <br /> Thomas McManus, 2959 Piedmont Avenue, Berkeley, owner of the property <br /> <br /> No one spoke in opposition to this appeal. <br /> <br /> Mayor Philcox declared the public hearing closed. <br /> <br /> The Council then considered the appeal and determined that the proposed <br />General Plan amendment would have the potential for significant adverse effect <br />upon the environment due to changes to the circulation, housing and construc- <br />tion, and open space elements. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember LeClaire, <br />that Resolution No. 76-274, denying the appeal of Thomas K. McManus of a deter- <br />mination by the City Manager that the preparation of an Environmental Impact <br />port is required for an application to change the General Plan designation of <br />approximately 66 acres of land located east of Hopyard Road between the Pleasanton <br />Recreation and Sports Park and the Arroyo Mocho from "Parks and Recreation"' to <br />'~edium Density Residential" be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> Mayor Philcox recessed the meeting at 9:I0 P.M. <br /> <br /> Mayor Philcox reconvened the meeting at 9:15 'P.M. <br /> <br />PUBLIC HEARINGS (Contd.) <br />Appeal of the decision of theCityManager to file a Negative Declaration for a <br />proposed retail center including a convenience market with a gasoline self- <br />service island on a site located immediately north of the intersection of Santa <br />Rita Ro~d and TassaJara Road (Contd. Open from 11-22-76) <br /> Mr. Harris presented h~s report dated December 1, 1976, regarding this <br />matter. <br /> <br /> Mayor Philcox declared Open the continued public hearing from the meeting <br />of November 22, 1976. <br /> <br /> The following person spoke in favor of the appeal: <br /> <br /> Robert M. Pearson, 3590 Churchill Court <br /> <br /> The following persons spoke in opposition to the appeal: <br /> <br /> Dr. Douglas Huntze, 514 Main Street, applicant for development of the <br /> property <br /> Phil Cameron, representing Short Stop Markets <br /> <br /> Mr. Pearson rebutted the testimony of the applicant. <br /> <br /> There being no further testimony, Mayor Philcox declared the public hearing~ <br />closed. <br /> <br /> Council discussion ensued regarding pedestrian and bike traffic problems, <br />youth activity, litter, and the impact of this development upon the environment. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember Brandes, <br />that Resolution No. 76-275, granting the appeal of the decision of the City Mana- <br />ger to file a Negative Declaration for a proposed retail center including a con- <br />venience market with a gasoline self-service island on a site located immediately <br />north of the intersection of Santa Rita Road and Tassajara Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, LeClaire and Mercer <br />NOES: Councilmember Herlihy and Mayor Philcox <br />ABSENT: None <br /> <br /> 2. 12/6/76 <br /> <br /> <br />
