MEETING OPEN TO THE PUBLIC <br /> Cookie Clark, 4250 Muirweod Drive, spoke in opposition to the <br />newspaper poll taken regarding the Las Positas Overcrossing. <br /> <br /> Cyril Kirkland, 4097 Brooks Court, spoke in opposition to the <br />newspaper poll and requested that the 400 signatures on the petition <br />presented to CalTrans be accepted in the survey, and that the results <br />of that poll be adjusted accordingly. <br /> <br /> Mayor Philcox asked that a copy of the petition be presented to <br />the City for informational purposes. <br /> <br />PUBLIC HEARINGS <br />~3qUes__t~of Dr. Dou_~las W. Huntze for permission to remove a Heritage <br />Tree (Evergreen Elm) on his prop~ert~. at 4156 Vineyard Avenue. <br /> Mr. Sooby presented his report dated October 20, 1976, re- <br />garding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Dr. Huntze was present and spoke in favor of removing the tree, <br />stating that there is a lot of foot traffic around the tree and if <br />it should break, there could be a fatality. <br /> <br /> Mr. Henry Cook, 4138 Vineyard Avenue, and Mr. Gary Hilborn, <br />4180 Cid Way, spoke in favor of the tree's removal. <br /> <br /> No one spoke in opposition to the removal of this Heritage Tree. <br /> The public hearing was declared closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Council- <br />member Mercer, that Resolution No. 76-237, approving the request of <br />Dr. Douglas W. Huntze for permission to remove a Heritage Tree <br /> (Evergreen Elm) on his property at 4156 Vineyard Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer and Mayor Philcox <br />NOES: Councilmembers Herlihy and LeClaire <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />~_tiono__f__O_rdinance No. 797,..a~ending Section 2-7.08(a), Article 8, <br />c_ha_j~te___r' 2, Title II of the Ordinance Code of the City of Pleasanton <br />to allow "automobile was~_g, including use of meChan~qal conveyors, <br />blowers and steam cleaners" as a conditional use in the C-C (Central <br />Commercial) District (Introduced on 9-27-76 by a 302 vote, continued <br />from the meeting of 10-11-76). <br /> Mayor Philcox stated that he had difficulty with this particular <br />ordinance. He felt that this ordinance is not in the best interest <br />of the City. He thinks the proposal is a good one but it is not good <br />planning to allow the use in the Central Commercial District, so <br />therefore he cannot suppor~ the ordinance though initially he did vote <br />to introduce it. <br /> <br /> Councilmember Mercer also changed'his position with regard to <br />allowing car washes in the Central Commercial district and supported <br />Mayor Philcox's remarks. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Council-- <br />member Herlihy, that Ordinance No. 797, amending Section 2-7.08(a), <br />Article 8, Chapter 2, Title II of the Ordinance Code of the City of <br /> <br /> 2. 10-26-76 <br /> <br /> <br />
