Mr. Scheidig answered Mr. Kidder's questions. <br /> <br /> Councilmember Brandes stated he wanted it made absolutely clear that he <br /> was in no way connected with the referendum petition that was being circulated <br /> by CARD regarding the LAVWMA project. <br /> <br /> PUBLIC HEARINGS <br /> Review of negative delcaration for a project to construct a 28-unit condominium <br /> at Black Avenue and Hopyard Road <br /> <br /> Application of Page Binkley to rezone approximately 2.1 acres on the southeast <br /> corner of Black Avenue and Hopyard Road from the RM-4000 (Multiple Residential) <br /> District to the PUD (Planned Unit Development) District and for approval of a <br /> development plan for a proposed 28-unit condominium proje~t..on the site <br /> Mr. Harris presented his report dated June 6, 1977, regarding these two <br /> items. <br /> <br /> Mr. Scheidig stated this property is a portion of the Morrison Homes liti- <br /> gation and as such is entitled to sewer permits, over and above those recently <br /> allocated. <br /> <br /> Mayor Philcox declared the public hearing open on the Negative Declaration <br /> and the Zoning Application. <br /> <br /> No one in the audience spoke in favor of these items. <br /> <br /> Mr. Robert Pearson, 3590 Churchill Court, spoke in opposition to the <br /> rezoning request, stating he felt the PUD zoning would increase density to <br /> an undesirable degree in this area. <br /> <br /> There being no further public testimony, ~yor Philcox declared the public <br /> hearing closed. <br /> <br /> 2. 6/13/77 <br /> <br /> <br />
