Joseph J. Brecher, 506 15th Street, Oakland, Environmental Attorney repre- <br />senting Pleasanton Safe Streets Association, stated the Environmental Impact <br />Report on the Del Valle Parkway is inadequate in that it is not properly <br />described under CEQA, there was failure to take mitigation measures, total <br />failure to mention possible alternatives, and artificial segmentation of the <br />total project. He stated he had advised Pleasanton Safe Streets Association <br />that there was sufficient evidence for legal action against the Del Valle <br />portion of the Morrison Homes project. <br /> <br /> Dudley Frost, representing Morrison Homes, presented the background and <br />history of the precise planning on the Creeks Bend project and the parkway. <br />He stated that additional delay would -increase~costs in the final development. <br /> <br /> Councilmember Mercer requested the City Council to delay adoption of the <br />ordinance regarding this matter for 60-90 days to allow him time to meet with <br />staff, developer, and interested citizens to investigate possible alternatives <br />that might be a better solution to the safety aspects of the presently pro- <br />posed Del Valle Parkway route. <br /> <br /> Councilmember Brandes stated that although he voted in favor of the ordi- <br />nance he was agreeable to a 60-90 day continuance of the item in order to allow <br />further investigation by Councilmember Mercer of possible alternatives for a <br />better solution regarding the safety element of the Del Valle Parkway. <br /> <br /> Councilmembers LeClaire, Herlihy, and Mayor PhiIcox concurred that the Del <br />Valle Parkway had been given sufficient consideration as to alternate routes, <br />that the developer had complied with all requested changes of the City Council, <br />that the Environmental Impact Report was adequate, and that there should be no <br />further delay of decision on this project. <br /> <br /> Councilmember Mercer reiterated his request for a 60-90 day continuance of <br />this item for additional study and review before making final decision. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember <br />Herlihy, that Ordinance No. 820, approving the development plan for Morrison <br />Homes, PUD-77-2, of a medium density residential planned unit development <br />proposed to be constructed on a 23 acre parcel of land located on the south <br />side of the Del Valle Parkway immediately east of Hopyard Road, zoning for the <br />property being Planned Unit Development (Medium Density Residential), subject <br />to conditions as established by Planning Commission Resolution 1511, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, and Mayor Philcox <br />NOES: Councilmembers Brandes and Mercer <br />ABSENT: None <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br /> 6. 5/23/77 <br /> <br /> <br />
