Appeal of a decision of the Design Review Board to deny a signing. program proposed by Blaze Custom Signs for the Davey Ace Hardware Store to be located at 1807 Santa Rita Road (Continued Open from 2-14-77 and 2-28-77) Mayor Philcox declared this item dismissed from the agenda due to prior resolution of the matter. Application of the Plannin5 Commission to fezone approximatel7 104 acres of land located west of Foothill Road near its intersection with Bernal Avenue from the R-1-40~O00 to the HPD (Hillside Planned Development) District' (Continued Open from 12-13-76~ 1-3-77,. and 2-14-77) Mr. Harris presented his report dated December 8, 1976, regarding this matter. Mayor Philcox declared Open the continued public hearing from the meetings of D.ecember 13, 1976, January 3, 1977, and February 14, 1977. No one in the audience spoke in favor of this item. Mr. Richard Braden, MacKay and Somps, representing one of the four owners of the property in question, spoke in opposition to this matter, stating the HPD zoning was not appropriate for the upper 50 acres of the Longview property amd requested that this particular parcel remain R-I-40,000 zoning, and cited reasons for this request. There being no further public testimony, Mayor Philcox declared the public hearing closed. Councilmember Brandes stated he was in favor of the Hillside Planned Development but felt the developer of the 50 acre'parcel of property should be allowed the opportunity of resolving problems under the current zoning. The majority of Council believed the zoning to be appropriate since the Ordinance was designed for hillsides such as those under consideration and theproperty is unique. After discussion, it was moved by Councilmember Herlihy, and seconded by Councilmember LeClaire, that Ordinance No. 815, to be read by title only and waiving further reading thereof, to fezone approximately 104 acres of land located west of Foothill Road near its intersection with Bernal Avenue from the R-1-40,000 to the HPD (Hillside Planned Development) District, and amend- ing the Zoning }~p of the City of Pleasanton accordingly, be introduced. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox NOES: Councilmember Brandes ABSENT: None MATTERS CONTINUED FOR DECISION There were no matters continued for decision presented at this meeting.
