PUBLIC HEARINGS <br />Review of a negative declaration for a project which would change the land use <br />designation of property along the west side of S.P.R.R.~ at the intersection <br />of Santa Rita Road near Sutter Gate Avenue <br /> <br />Application of Lee slaughter for a general plan amendment which would change <br />the land use designation of a 3.8 acre .parcel of land located along the west <br />side of the. S.P.R.R.~. beginning at the intersection of Santa Rita Road and the <br />S.P.R.R. (near Sutter Gate Avenue)~ and extending about 1~.500 feet south~ from <br />"Open .Sp~ce-Public Health and Safety" to "General and Limited Industrial" <br /> Mr. Harris presented his report dated November 18, 1977, regarding the <br />Negative Declaration and the application for general plan amendment for Holly <br />Sugar property. <br /> <br /> Mr Scheidig presented a draft resolution regarding the Negative Declaration <br /> - <br />for this project, and reviewed the criteria for determining whether a Negative <br />Declaration or an Environmental Impact Report is appropriate for the application. <br /> <br /> Mayor Philcox declared the public hearing open on the Negative Declaration <br />and the application. <br /> <br /> Mr. John P. Corley, Attorney representing the applicant, spoke in favor of <br />the application and concurred with the Planning Commission decision for approval. <br /> <br /> No one in the audience spoke in opposition to the Negative Declaration or <br />the application. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed on the Negative Declaration and the application. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Mercer, that Resolution No. 77-314, determining, on the basis of <br />a review of initial environmental study done for this project, that no signifi- <br />cant adverse environmental impact would occur as outlined in the City's guide- <br />lines and that a Negative Declaration is appropriate for a project which would <br />change the land use designation of property along the west side of S.P.R.R., at <br />the intersection of Santa Rita Road near Sutter Gate Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and ~yor Philcox <br />NOES: Councilmember LeClaire <br />ABSENT: None <br /> <br /> Councilmember LeC!aire stated she voted No because of the uncertainty of <br />the type of development proposed for the subject property. <br /> <br /> .After further discussion, it was moved by [~yor Philcox, and seconded by <br />Councilmember Mercer, that Resolution No. 77-315, approving tha application <br />by Lee Slaughter for Holly Sugar Company for a general plan amendment which <br />would change the land use designation of a 3.8 acre parcel of land located <br />along the west side of the S.P.R.R., beginning at the intersection of Santa <br />Rita Road and the S.P.R.R. (near Sutter Gate Avenue), and extending about <br />1,500 feet south, from "Open Space-Public Health and Safety" to "General and <br />Limited Industrial", be adopted. <br /> <br /> 3. 11/29/77 <br /> <br /> <br />
