There being no further public testimony, Mayor Philcox declared the public <br />hearing closed on the Negative Declaration and the application. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy, <br />that Resolution No. 77-299, determining, on the basis of a review of initial <br />environmental study done for this project, that no significant adverse environ- <br />mental impact would occur as outlined in the City's guidelines and that a Nega- <br />tive Declaration is appropriate for a pro~ect to rezone four parcels of land con- <br />taining approximately 1.3 acres located at 915, 923, and 929 Santa Rita Road, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember LeClaire~ <br />that Ordinance No. 835, to be read by title only and waiving further reading <br />thereof, to rezone four parcels of land containing about 1.3 acres located at <br />915, 923, and 929 Santa Rita Road from the C-S (Commercial Service) and C-F <br />(Commercial Freeway) Districts to the C-C (Central Commercial) District, and <br />amending the Zoning Map of the City of Pleasanton accordingly, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />Appeal of Rodhey Cowin of a decision of the Plannin~ Commission denyin~ his <br />application for a home occupation permit to allow the operation of a vendin~ <br />machine service from a residence located at 3855 Mesa Verde Court <br /> Mr. Harris presented his report dated November 1, 1977, regarding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Mr. Rodney Cowin, appellant, 3855 Mesa Verde Court, spoke in favor of the <br />appeal and presented reasons why he felt his home occupation permit should be <br />granted. <br /> <br /> Mro Thomas H. Murphy, 3884 Mesa Verde Court, representing 9 and the 10 <br />residents on Mesa Verde Court, stated that all were in opposition to the appeal <br />to allow a vending machine service at 3855 Mesa Verde Court. <br /> <br /> Mr. Cowin rebutted that he did not feel that 9 of the residents were in <br />opposition to his business, stating that he thought it was more like 5 residents~ <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed. <br /> <br /> Council discussed the violations to the Home Occupation Ordinance committed <br />by Mr. Cowin and his lack of adherence. <br /> <br /> It was moved by Councilmember LeClaire, and seconded by Councilmember Brandes, <br />that Resolution No. 77-300, denying the appeal of Rodney Cowin of a decision of <br />the Planning Commission denying his application for a home occupation permit to <br />allow the operation of a vending machine service from a residence located at 3855 <br />Mesa Verde Court, be adopted. <br /> <br /> 3. 11/8/77 <br /> <br /> <br />
