It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy, that Ordinance No. 834, to be read by title only and waiving further reading thereof, to rezone a 2.56 acre parcel of land located between the Arroyo del Valle and the future Del Valle Parkway roughly 1,600 feet east of Hopyard Road from the RM-2000 (Multiple Family Residential) District to the PUD (Planned Unit Development) District and to approve a development plan proposing the construc- tion of a 22 unit, two-story townhouse development immediately westerly of the existing single family residence on the lot, and amending the Zoning Map of the City of Pleasanton accordingly, be introduced. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, LeClaire, and Mayor Philcox NOES: Councilmember Mercer ABSENT: None Approval. of Final Map and Improvement Plans, Tract 3359, Creeks Bend, Morrison Homes M~. Sooby presented his report dated September 14, 1977, regarding approval of final map and improvement plans for Tract 3359, Creeks Bend, Morrison Homes. Mr. Scheidig asked Dudley Frost, representing Morrison Homes, if he desired to have City Council make a decision on this item tonight in light of pending litigation with Pleasanton Safe Streets Association and the potential conse- quences of a decision in favor of Pleasanton Safe Streets Association. }~. Frost stated he desired City Council to make a determination on this item at this time and that he was aware of the ramifications, and was agreeable to any clarifying conditions necessary by City regarding Morrison Homes' posi- tion. It was moved by Councilmember LeClaire, and seconded by Councilmember Brandes, that Resolution No. 77-270, approving final map and improvement plans for Tract 3359, Creeks Bend, Morrison Homes, and authorizing execution of a subdivision improvement agreement, including a paragraph regarding the Pleasanton Safe Streets Association litigation, be adopted. It was moved by Councilmember LeClaire, and seconded by Councilmember Herlihy, that Resolution No. 77-271, approving Heritage Tree removal, Creeks Bend, be adopted.
