1313 <br /> <br /> Mr. Datwyler asked that if his project was delayed, could he obtain a time <br /> extention on his sewer permits. <br /> <br /> Council agreed to a time extension in the event Mr. Datwylerts development <br /> was unavoidably delayed as a result of the Pleasanton Safe Street Association <br /> Suit against Morrison Homes and the City. The time extension would be equiva- <br /> lent to the actual delay experienced by Mr. Datwyler. <br /> <br /> Mrs. Olga Morrow, 4593 Del Valle Parkway, spoke in opposition to the Negative <br /> Declaration as it relates to traffic. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed on the Negative Declaration and application of Darwin. Datwyler. <br /> <br /> Mr. Scheidig reviewed the City's guidelines for determining whether to re- <br />quire an Environmental Impact Report or a Negative Declaration He noted that <br />the City Council had its environmental guidelines before them, and Mr. Harris <br />reviewed what mitigation measures would obviate or minimize any potential <br />adverse effects of the project. <br /> <br /> Mayor Philcox noted in discussing the Negative Declaration for the project <br />that Conditions 1-3, 6-9, 13-23, 25 and 27 attached to the proposed rezoning <br />would mitigate problems relating to the following aspects of the project: light <br />glare, air quality, traffic, energy consumption, water consumption, aesthetics, <br />reduction in vegetation, dust generation, congestion of vehicles in the area, <br />and recreation. <br /> <br /> It was moved by Mayor Philcox, and seconded by Councilmember LeClaire, that <br />Resolution No. 77-269, determining, on the basis of a review of initial environ- <br />mental study done for this project, that no significant adverse environmental <br /> Cit ' <br />impact would occur as outlined in the y s guidelines, due to the inclusion <br />of mitigation measures to off-set any adverse environmental effects, that a <br />Negative Declaration is appropriate for a project to fezone a 2.56 acre parcel <br />of land located between the Arroyo del Valle and the future Del Valle Parkway <br />roughly 1,600 feet east of Hopyard Road from the RM-2000 (Multiple Family Resi- <br />dential) District to the PUD (Planned Unit Development) District and to approve <br />a development plan proposing the construction of a 22 unit, two-story townhouse <br />development immediately westerly of the existing single family residence on the <br />lot, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, and Mayor Philcox <br />NOES: Councilmember Mercer <br />ABSENT: None <br /> <br /> Council discussion then ensued regarding the proposed rezoning and development <br />plan. The Council reviewed the conditions of approval and requested the City <br />Attorney to devise language regarding the Pleasanton Safe Streets Association <br />Suit and extension of time for sewer permits. <br /> <br /> Mr. Scheidig advised Council of amendments to Condition No. 17, and recom- <br />mended language for Conditions 28 and 29 regarding~ respectively, the Pleasanton <br />Safe Streets Association litigation and extension of time for sewer permits. <br /> <br /> 10/11/77 <br /> <br /> <br />
