PUBLIC HEARINGS (Contd.) <br />Review of negative declaration for a General Plan Amendment to change land use <br />designation of land located between Hopyard Road and Valley Avenue from high <br />density residential to medium density resi.dential~ and to make changes to text <br />of General Plan (Continued Open from 8-23-77 and 9-13-77) <br /> <br />~pplication of Morrison Homes~ Inc.~ for a General Plan Amendment to chan~e the <br />land use designation of an approximately 10 acre site located between Hopyard <br />Road and Valley Avenue immediately southeast of the Alpha Beta Shopping.Center <br />from high density residential to medium density residential~ and to make certain <br />changes to the text of the General Plan!as it pertains to residential density <br />(Continued Open from 8-23-77 and 9-13-77) <br /> Mr. Harris presented his report dated September 2, 1977, regarding these two <br />items. <br /> <br /> Mr. Scheidig reviewed the procedure for determining whether or not a Nega- <br />tive Declaration or an Environmental Impact Report would be proper on this <br />application and reminded Council that consideration tonight was on a General <br />Plan amendment, not the project itself. <br /> <br /> Mayor Philcox declared the public hearing open on the Negative Declaration <br />and the application. <br /> <br /> Mr. Dudley Frost, representing Morrison Homes, spoke in favor of the Nega- <br />tive Declaration and the application, stating he concurred with staff recommenda- <br />tions regarding this matter. <br /> <br /> Mr. James De Young, 1020 Division Street, spoke in opposition to the General <br />Plan amendment as it relates to the 25% limitation of density concerning resi- <br />dential zoning regarding PUD. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Mercer, that Resolution No. 77-252, on the basis of a review of <br />initial environmental study done on this application after consideration of the <br />environmental guidelines for negative declaration and environmental impact reports, <br />finding no significant adverse environmental impact would occur as outlined in the <br />City's guidelines, and finding that no mitigation measures were necessary since no <br />significant adverse environmental impacts would occur, determine that a Negative <br />Declaration is appropriate for a General Plan amendment to change land use designa- <br />tion of land located between Hopyard Road and Valley Avenue from high density <br />residential to medium density residential, and to make changes to text of General <br />Plan, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> 4. 9/20/77 <br /> <br /> <br />
