PUBLIC HEARINGS <br />Application of D~.~win Datwyler to rezone a 2.56 acre parcel of land located <br />between the Arroyo del Valle and the future Del Valle Parkway roughly 1~600 <br />feet east of Hopyard Road from the RM-2000 (Multiple FamilX Residential) <br />District to the PUD (Planned Unit Development) District and to approve a <br />development plan propo.~.ipg the construction of a 22 unit, two-story town- <br />house development immediately westerly of the existin~ si~le family resi- <br />dence on the lot <br /> Mayor Philcox stated it was now in order to determine whether or not to <br />continue this item to the meeting of October 11, 1977. <br /> <br /> Mr. Darwin Datwyler, applicant, urged Council to consider the matter tonight <br />due to time restrictions on the sewer permits for this proposed project. <br /> <br /> Council inquired as to whether Mr. Datwyler's sewer permit deadline could be <br />extended Mr Scheidig stated that intervening circumstances could allow a time <br /> · . <br />extension. <br /> <br /> Mr. Scheidig stated that the litigation between Pleasanton Safe Streets <br />Association vs. City of Pleasanton had not been settled as of this date, and <br />was taken under submission by the Judge. It is hoped that a decision on the <br />preliminary injunction will be rendered prior to October 11, 1977. <br /> <br /> ~. Scheidig further stated this matter did affect Mr. Datwyler's applica- <br />tion because Mr. Datwyler's property must front on a public street and have <br />accress to Hopyard Road. Mr. Datwyler's property is to the south of the Del <br />Valle Parkway alignment and thus could be affected by the outcome of the liti- <br />gation. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember LeClaire, to open the public hearing on the application of Darwin <br />Datwyler to rezone a 2.56 acre parcel of land located between the Arroyo del <br />Valle and the future Del Valle Parkway roughly 1,600 feet east of Hopyard Road <br />from the RM-2000 (Multiple Family Residential) District to the PUD (Planned Unit <br />Development) District and to approve a development plan proposing the construc- <br />tion of a 22 unit, tw6-story townhouse development immediately westerly of the <br />existing single family residence on the lot, and continue the item to the meeting <br />of October 11, 1977, 8:00 P.M., Pleasanton Council Chambers. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Approval of Final Map and Improvement Plans, Tract 3359, Creeks Bend~ Morrison <br />Homes <br /> Council determined to continue this item to the meeting of October 11, 1977, <br />due to pending litigation on the matter.
