463 Review of negative declaration for a project to rezone land located at southwest corner of Main Street and Bernal Avenue from the O (Office) District and P (Public and Institutional) District to the C-C (Central Commercial) District ~pp!i~ation of John Edgr~n~ Ma. nuel Delis and Valley Bank to rezone approximately 3.1 acres of land located at the southwest corner of Main Street and Bernal Avenue and including all of those properties lying between the City Hall and Main Street, and between Bernal Avenue and the Pleasanton'School District Administration Build- ing, from the 0 (Office) District and the P (Public and Institutional) District to the C-C (Central Commercial) District Mr. Harris presented his report dated September 1, 1977, regarding these two items. Mayor Philcox declared the public hearing open on the Negative Declaration and the application. Mr. Mark Gerton, representing the applicants, spoke in favor of the applica- tion and presented background information on the subject property. No one spoke in opposition to the Negative Declaration or application. Mayor Philcox declared the public hearing closed on the Negative Declaration and the application. Councilmember LeClaire expressed concern that possible uses of the area would not be compatible or in character with the downtown heritage theme, and stated she felt C-C zoning was not appropriate. Councilmember Brandes asked if it would create a hardship on the property owners if this item were to be continued for two or three months for further review of uses. Mr. Gerton replied that it would create a hardship on the pro- perty owners to postpone a decision on this item. Considerable Council discussion ensued regarding permitted uses, conditional uses and prohibited uses in the C-C District, the control of the Civic Center Overlay and Design Review regarding development of this area, and parking. Council also discussed the Negative Declaration. Mr. Scheidig reviewed the difference between a Negative Declaration and an Environmental Impact Report and the criteria for determining if significant environmental consequences would re- sult from a project. It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that Resolution No. 77-240, on the basis of a review of initial environmental study done for this project, finding no significant adverse environmental impact would occur as outlined in the City's guidelines, and finding that no mitigation measures were necessary since no significant adverse environmental impacts would occur, determine that a Negative Declaration is appropriate for a project to re- zone'land located at the southwest corner ot Main Street and Bernal Avenue from the 0 (Office) District and P CPublic and Institutional) District to the C-C (Central Commercial) District, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox NOES: Councilmember LeClaire ABSENT: None 5. 9/13/77
