463 <br /> <br />Review of negative declaration for a project to rezone land located at southwest <br />corner of Main Street and Bernal Avenue from the O (Office) District and P (Public <br />and Institutional) District to the C-C (Central Commercial) District <br /> <br />~pp!i~ation of John Edgr~n~ Ma. nuel Delis and Valley Bank to rezone approximately <br />3.1 acres of land located at the southwest corner of Main Street and Bernal Avenue <br />and including all of those properties lying between the City Hall and Main Street, <br />and between Bernal Avenue and the Pleasanton'School District Administration Build- <br />ing, from the 0 (Office) District and the P (Public and Institutional) District to <br />the C-C (Central Commercial) District <br /> Mr. Harris presented his report dated September 1, 1977, regarding these two <br />items. <br /> <br /> Mayor Philcox declared the public hearing open on the Negative Declaration <br />and the application. <br /> <br /> Mr. Mark Gerton, representing the applicants, spoke in favor of the applica- <br />tion and presented background information on the subject property. <br /> <br /> No one spoke in opposition to the Negative Declaration or application. <br /> <br /> Mayor Philcox declared the public hearing closed on the Negative Declaration <br />and the application. <br /> <br /> Councilmember LeClaire expressed concern that possible uses of the area would <br />not be compatible or in character with the downtown heritage theme, and stated she <br />felt C-C zoning was not appropriate. <br /> <br /> Councilmember Brandes asked if it would create a hardship on the property <br />owners if this item were to be continued for two or three months for further <br />review of uses. Mr. Gerton replied that it would create a hardship on the pro- <br />perty owners to postpone a decision on this item. <br /> <br /> Considerable Council discussion ensued regarding permitted uses, conditional <br />uses and prohibited uses in the C-C District, the control of the Civic Center <br />Overlay and Design Review regarding development of this area, and parking. <br /> <br /> Council also discussed the Negative Declaration. Mr. Scheidig reviewed the <br />difference between a Negative Declaration and an Environmental Impact Report and <br />the criteria for determining if significant environmental consequences would re- <br />sult from a project. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, <br />that Resolution No. 77-240, on the basis of a review of initial environmental <br />study done for this project, finding no significant adverse environmental impact <br />would occur as outlined in the City's guidelines, and finding that no mitigation <br />measures were necessary since no significant adverse environmental impacts would <br />occur, determine that a Negative Declaration is appropriate for a project to re- <br />zone'land located at the southwest corner ot Main Street and Bernal Avenue from <br />the 0 (Office) District and P CPublic and Institutional) District to the C-C <br />(Central Commercial) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />NOES: Councilmember LeClaire <br />ABSENT: None <br /> <br /> 5. 9/13/77 <br /> <br /> <br />
