REPORTS OF THE CITY ATTORNEY Approval of Contract between LAVWMA and East Bay Dischargers AuthoritX Mr. Scheidig presented his report dated July 20, 1977, regarding this matter. After discussion, it was moved by Councilmember LeClaire, and seconded by Mayor Philcox, that Resolution No. 77-203, approving the proposed agreement be- tween East Bay Dischargers Authority and Livermore-Amador Valley Water ~nagement Agency for participation in East Bay Dischargers Authority interceptor-outfall system as submitted to the City Council at its meeting of July 25, 1977, subject to review by and approval by the City Attorney and the Pleasanton LAVWMA repre- sentatives of any modifications to Paragraph 10, Exhibit B and any other modifi- cations requested by the other participating agencies, be adopted. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox NOES: Councilmember Brandes ABSENT: None COMMUNICATIONS There ware no Communications presented at this meeting. CITY COUNCIL CO~LMITTEE REPORTS Councilm~nbers presented various Committee Reports for the information of the Council. Mr. Brown presented a letter from the State Water Resources Control Board dated July 12, 1977, regarding status of negotiations between Pleasanton and Valley Conmunity Services District relative to buy-in agreemant. Mr. Brown suggested that City staff meet with V.C,S.D. staff to begin discussions on this matter. It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, instructing staff to proceed with discussions with Valley Community Services Dis- trict staff regarding buy-in agreement relative to minor issues, and also in- structing the City Manager to write a letter to the State Water Resources Con- trol Board informing them that the City of Pleasanton has not accepted the Brown and Caldwall 1976 Financial Report regarding this matter and disagrees with the findings in that report. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and ~yor Philcox NOES: None ABSENT: None ~TTERS INITIATED BY COUNCIL MDIBERS CQuncilmember Mercer expressed appreciation to the Council on their unanimous stand rejecting the CARD Raferendum Petition. Councilmember LeClaire reported there had been three deaths from Encephalitis within a month, and requested a report from the Alameda County Health Department regarding the circumstances of this disease. Councilmember LeClaire stated that Bar Fence Company had been parking large trucks on the Council Chambers parking lot over the weekend, and requested this matter be investigated and corrected. 10. 7/25/77
