The City Attorney advised that it would be permis- <br />sible to delay the effect of the amendments so that those who have already re- <br />ceived Residential ~j!ocation Program approval would not have to pay the higher <br />fees proposed. Such "grandfather" clauses are frequently used by cities when a <br />new or increased requirement is adopted. <br /> <br /> Mr. Dean LaField, 3462 Mr. Diablo Boulevard, Lafayette, stated he felt the <br />increase of the Residential Construction Tax was improper, and unfair to the <br />buyer. <br /> <br /> Mr. Bob Miller, representing Morrison Homes, stated he felt the Residential <br />Construction Tax should be lower to allow more moderate income housing in <br />Pleasanton. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that Ordinance No. 856, to separate the park dedication <br />fee collection function from the Residential Construction Tax collection in- <br />cluding deleting Section 1-6.65(c) from Article 6, Chapter 3, Title I of the <br />Ordinance Code of the City of Pleasanton and amending Section 2-4.31 of Article <br />10, Chapter 1, Title II of the Ordinance Code of the City of Pleasanton, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Wood, and Mayor Mercer <br />NOES: None <br />ABSENt: Councilman Kephart <br /> <br />Adoption of Ordinance No. 857~ to remove the fee schedule for the Residential <br />Construction Tax from the Residential Construction Tax Ordinance and to place <br />the fee schedule in the resolution establishinM fees and charges for various <br />municipal services includinM amendin~ Section 1-6.62 of Article 6~ Chapter 3~ <br />Title I of the Ordinance Code of the City of Pleasanton <br /> (Intro. 6-20-78,' by a vote of 3-A~es,. 2-Absent) <br /> <br /> 4. 6/27/78 <br /> <br /> <br />
