Brandes~ Jr., of a decision of the Planning Commission and Design Review BOard app. roVi.ng Cases UP-78-6 and Z-78-42, applications for a Conditional Use Permit and design review for a service station proposed for the 1.1 acre site located at the northwest corner of the intersection of tIqp~ .yard Road and Johnson Industrial Drive Appeal of Wickland Oil Company of Two Conditions imposed by the Plannin~ Com- mission on Cases UP-78-6 and Z-78-42 ~layor Mercer stated he would abstain from any discussion or decision on these items because of Conflict of Interest. Mayor Mercer turned the conduct of the meeting over to Vice Mayor Brandes. Vice Mayor Brandes stated this item was to consider his appeal of the decision of the Planning Commission and Design Review Board for a proposed service station by Wickland Oil Company. Mr. Harris stated that the appeal of Wickland Oil Company regarding two of the conditions imposed by the Planning Commission on the application should also be heard at this time. Mr. Lee Amaral, Attorney representing Wickland Oil Company, requested a con- tinuance of this item as he had been out of town on a Court case and was unable to prepared for this presentation. After discussion, it was moved by Vice Mayor Brandes, and seconded by Councilmember Butler, to open the public hearing and continue the appeal of Frank C. Brandes, Jr., of a decision of the Planning Conmission and Design Review Board approving Cases UP-78-6 and Z-78-42, applications for a Condi- tional Use Permit and design review for a service station proposed for the 1.1 acre site located at the northwest corner of the intersection of Hopyard Road and Johnson Industrial Drive, and to open the public hearing and continue the appeal of Wickland Oil Company of two conditions imposed by Planning Com- mission on these same cases, to the meeting of May 23, 1978, 8:00 P.M., in the Pleasanton Council Chambers.
