322, <br /> <br /> Mr. Glenn Moore offered testimony in rebuttal to the residents opposing <br /> the Negative Declaration and application. <br /> <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> Councilmember Wood stated he was opposed to any rezoning to "Office" <br /> outside of the downtown area, therefore he would vote to deny the amendment. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Kephart, that Resolution No. 78-66 determining, on the basis of <br />a review of initial environraental study done for this project, that no sig- <br />nificant environmental impact would occur and that a Negative Declaration is <br />appropriate for the project consisting of a change in the General Plan desig- <br />nation of a 3.8 acre parcel of land located on the east side of Santa Rita Road <br />immediately north of the Arroyo Mocho from High Density Residential to Commercial <br />and Offices be adopted. <br /> The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Kephart and Mayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br /> It was moved by Councihnember Brandes, and seconded by Councilmember Kephart, <br />that Resolution No. 78-67, approving the application of Van Bokkelen-Cole Company <br />for a General Plan amendment for a 3.8 acre parcel located on the east side of <br />Santa Rite Road imnediately north of the Arroyo Mocho from High Density Resi- <br />dential to Commercial and Offices, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Kephart and Mayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br /> Mayor Mercer recessed the meeting at 9:45 P.M. <br /> <br /> Mayor Mercer reconvened the meeting at 9:55 P.M. <br /> <br />PUBLIC HEARINGS (Cont'd) <br />The adoption of an ordinance extending for eight (8) months the H-O (Historical <br />Landmark Overlay) District Classification established by Ordinance No. 838 (An <br />Interim Ordinance Placing Certain Structures into a tl-O (Historical Landmark <br />Overlay) District for Four Months) ~nd adopting the same as .an Urgency Measure <br /> Mr. Harris presented his report dated 3-16-78, regarding this matter. <br /> <br /> Councihnember Brandes stated he had been meeting with the Historical Advisory <br />Cormnittee and that they were diligently working on this matter. <br /> <br /> Mayor Mercer stated he was strongly opposed to this ordinance because at the <br />time the Heritage Sub-Committee of the Bicentennial Committee included the homes <br />now included in the Historical Overlay District, the owners were advised by the <br />Con~nittee that their homes would only be included during the 1976 Bicentennial <br />Year, and he did not feel it was fair to subject the horaeowners to this ordinance. <br /> <br /> Mr. Levine advised that a 4 to 5 vote was required to adopt an extension of <br />an urgency ordinance. <br /> <br /> 4. 3/28/78 <br /> <br /> <br />
