MATTERS CONTINUED FOR DECISION Adoption of Ordinance No. 842~ adding Chapter 5 to Title IV (Healthy Safety~ Moral~ and General Welfare) of the Ordinance Code of the City of Pleasanton regulating the display of sexually explicit readin~ material in commercial establishments (Introduced January 10, 1978, 4 Ayest 1 Absent) Mayor Philcox stated this ordinance was introduced on January 10, 1978, by a vote of 4 Ayes and 1 Absent, and that it was now in order to adopt the ordi- nance. It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, that Ordinance No. 842, adding Chapter 5 to Title IV (Health, Safety, Moral, and General Welfare) of the Ordinance Code of the City of Pleasanton regulating the display of sexually explicit reading material in commercial establishments, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox NOES: Councilmember LeClaire ABSENT: None Councilmember LeClaire stated that she was absent when this ordinance was introduced, and voted No on the adoption because she felt this ordinance seriously violated the First Amendment rights.
