The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox NOES: None ABSENT: None A~peal of Frank Brandes of a decision of the Board of Adjustment approving Case V-7.7%18, an application of William Hirst for a Variance to various sections of Article.~.~ Chapter 2~..Title II of the Ordinance Code of the City of Pleasanton to allow the construction of additions to the office buildin~ located at 147 Bernal Avenue which would encroach into the required front and side yards and exceed th~ .~.!lowa~.le floor area/lot size ratio of the Subject site,.the property is in the 0 (Office) District Mr. Harris presented his report dated January 17, 1978, regarding this matter. Mayor Philcox declared the public hearing open. Councilmember Brandes stated he initiated this appeal because he felt the excess floor area on the lot size was inappropriate and might be precedent setting if allowed. Mr. William Mirst, 147 Bernal Avenue, presented reasons why he felt the Variance should be allowed, and urged Council to deny the appeal. Mr. Walter C. Wood, 5284 Northway Road, stated that while he felt the Zoning Codes should be upheld, the need for additional office space in the downtown and Civic Center area should be taken into consideration in this instance. Councilmember Brandes rebutted by stating the findings against the Zoning Ordinance for this Variance made it inappropriate in his opinion. There being no further public testimony, Mayor Philcox declared the public hearing closed. Mr. Levine read the entire definition of gross floor area from the Code for the information of the Council. After considerable discussion, it was moved by Councilmember Mercer, and seconded by Councilmember Herlihy, that Resolution No. 78-21, denying the appeal of Frank Brandes of a decision of the Board of Adjustment approving Case V-77-18, an application of William Hirst for a Variance to various sections of Article 3, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow the construction of additions to the office building located at 147 Bernal Avenue which would encroach into the required front and side yards and exceed the allow- able floor area/lot size ratio of the subject site, the property is in the 0 (Office) District, be adopted.
