The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br />A~peal of Frank Brandes of a decision of the Board of Adjustment approving <br />Case V-7.7%18, an application of William Hirst for a Variance to various <br />sections of Article.~.~ Chapter 2~..Title II of the Ordinance Code of the City <br />of Pleasanton to allow the construction of additions to the office buildin~ <br />located at 147 Bernal Avenue which would encroach into the required front and <br />side yards and exceed th~ .~.!lowa~.le floor area/lot size ratio of the Subject <br />site,.the property is in the 0 (Office) District <br /> Mr. Harris presented his report dated January 17, 1978, regarding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Councilmember Brandes stated he initiated this appeal because he felt the <br />excess floor area on the lot size was inappropriate and might be precedent <br />setting if allowed. <br /> <br /> Mr. William Mirst, 147 Bernal Avenue, presented reasons why he felt the <br />Variance should be allowed, and urged Council to deny the appeal. <br /> <br /> Mr. Walter C. Wood, 5284 Northway Road, stated that while he felt the Zoning <br />Codes should be upheld, the need for additional office space in the downtown and <br />Civic Center area should be taken into consideration in this instance. <br /> <br /> Councilmember Brandes rebutted by stating the findings against the Zoning <br />Ordinance for this Variance made it inappropriate in his opinion. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed. <br /> <br /> Mr. Levine read the entire definition of gross floor area from the Code for <br />the information of the Council. <br /> <br /> After considerable discussion, it was moved by Councilmember Mercer, and <br />seconded by Councilmember Herlihy, that Resolution No. 78-21, denying the appeal <br />of Frank Brandes of a decision of the Board of Adjustment approving Case V-77-18, <br />an application of William Hirst for a Variance to various sections of Article 3, <br />Chapter 2, Title II of the Ordinance Code of the City of Pleasanton to allow the <br />construction of additions to the office building located at 147 Bernal Avenue <br />which would encroach into the required front and side yards and exceed the allow- <br />able floor area/lot size ratio of the subject site, the property is in the 0 <br />(Office) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br />Appeal of Oakland Neon Signs to a decision of the Design Revi.ew Board denying <br />Case Z-77~184~ an application for design review for a 2~'x14' internal.iF <br />illuminated wall sign proposed to be installed on the buildin~ located at <br />435 Main Street (Continued Open from 1-10-78) <br /> Mr. Harris presented his report dated January 3, 1978, regarding this matter, <br />and stated this item had been continued from the meeting of January 10, 1978, for <br />full Council attendance. <br /> <br /> 3. 1/24/78 <br /> <br /> <br />
