The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and ~yor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember LeClaire abstained from voting on the Minutes of 1-10-78, due <br />to her absence from that meeting. <br /> <br />b~ETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Council. <br /> <br />PUBLIC HEARINGS <br />Review of a Ne~.ative Declaration for Case RZ-77-15~. the application of Mobil Oil <br />Corporation to rezone the propertX located at 5311 HoByard Road from C-F (Commer- <br />cial Fre~yay) to C-S (Commercial Service) District (Continued Open from 1-10-78) <br /> <br />Appeal of Mobil Oil Corporation to a decision of the Planning CoPmission denying <br />Case RZ-77-15, the application of Mobil Oil Corporation to rezone the property <br />located at 5311 ttop~ard Road from C-F (Commercial Freewa~) to C-S (Commercial <br />Service) District (Continued Open from 12-13-77 and 1-10-78) <br /> Mr. Harris presented his report dated January 3, 1978, regarding this matter. <br /> <br /> Mayor Philcox declared the continued public hearing open on the Negative <br />Declaration and the appeal. <br /> <br /> Mr. Tom Bardett, representing Mobil Oil Corporation, explained the concept <br />of the operation contemplated, and urged approval of the appeal. <br /> <br /> Mr. Frank Narcisso, representing Mobil Oil Corporation, also spoke in favor <br />of tha appeal. <br /> <br /> Mr. Walter C. Wood, 5284 Northway Road, stated that the proposed location <br />for this application was one of the busiest intersections in the City. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed on the Negative Declaration and appeal of Mobil Oil Corporation. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, <br />that Resolution No. 78-19, determining, on the basis of a review of initial en- <br />vironmental study done for this project, that no significant environmental impact <br />would occur as outlined in the City's guidelines and that a Negative Declaration <br />is appropriate for Case RZ-77-15, the application of Mobil Oil Corporation to re- <br />zone the property located at 5311 Hopyard Road from C-F (Commercial Freeway) to <br />C-S (Commercial Service) District, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />NOES: Councilmember LeClaire <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember LeClaire, and seconded by <br />Councilmember Brandes, that Resolution No. 78-20, denying the appeal of Mobil <br />Oil Corporation to a decision of the Planning Commission denying Case RZ-77-15, <br />the application of Mobil Oil Corporation to rezone the property located at 5311 <br />Hopyard Road from C-F (Commercial Freeway) to C-S (Commercial Service) District, <br />be adopted. <br /> <br /> 2. 1/24/78 <br /> <br /> <br />
