REPORT OF THE CITY ATTORNEY <br />Sexually Explicit Report and Ordinance <br /> Mr. Scheidig presented his report dated January 5, 1978, regarding this <br />matter. He stated that the books presented to City Council by Mrs. Sandra <br />Cherry at the meeting of December 13, 1977, were deemed by the Alameda County <br />District Attorney not to be pornographic. <br /> <br /> Mayor Philcox commended Mr. Scheidig for his thorough report on this issue. <br /> <br /> Mayor Philcox read a letter dated January 10, 1978, from Assemblyman Floyd <br />Mori, urging adoption of a local ordinance to regulate the display of obscene <br />and pornographic material. <br /> <br /> The following persons spoke in favor of an ordinance to control the display <br />of obscene and pornographic material in commercial establishment in Pleasanton: <br /> <br /> Walter Wood, 5284 Northway Road <br /> LaVere Adams, 1960 Brooktree <br /> David B. Cummings, 461 Ewing Drive <br /> Mr. Cummings read comments of David C. Peterson, 1651 Orchard <br /> Way, in favor of an ordinance. <br /> Joe O. Toland, 1624 Orchard Way <br /> William H. Kennedy, 5664 Hansen Drive <br /> Viola Goodwin, 4582 Gatetree Circle <br /> Ann Hunter, 1870 Tanglewood Way <br /> Roy D. King, 560 Tawny Drive <br /> Sandra Cherry, 4149 Moselle Court <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br />Mayor Philcox, that Ordinance No. 842, to be read by title only and waiving <br />further reading thereof, adding Chapter 5 to Title IV (Health, Safety, Moral, <br />and General Welfare) of the Ordinance Code of the City of Pleasanton regulating <br />the display of sexually explicit reading material in commercial establishments, <br />be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: Councilmember LeClaire <br /> <br /> Councilmember Brandes reiterated his position that he felt a more stringent <br />ordinance should be adopted to regulate browsing and sale of sexually explicit <br />material to minors. <br /> <br /> Mayor Philcox recessed the meeting at 9:30 P.M. <br /> <br /> Mayor Philcox reconvened the meeting at 9:40 P.M. <br /> <br /> Mayor Philcox introduced Council Candidates Foley, Kephart, Minahan, and <br />Wood. <br /> <br />PUBLIC HEARINGS <br />Review of a NeMative Declaration for Case RZ-77-15~.. the application of Mobil <br />Oil Corporation to rezone the property.~ocated at 5311 Hopyard Road from C-F <br />(Commercial Freeway) to C-S (Commercial Service) District <br /> <br /> 3. 1/10/78 <br /> <br /> <br />
