There being no further public testimony, Mayor Mercer declared the public hearing closed. After considerable discussion, it was moved by Councilmember Brandes, and seconded by Councilmember Kephart, that Ordinance No. 874, amending the permitted and conditionally permitted uses in the CR(M) and CR(P) Districts as recommended by the Planning Commission and in addition a category of Tire, Batteries and Accessories of major department stores be shown as Permitted in the CR(M) and CR(P) Districts, be introduced. The roll call vote was as follows: AYES: Councilmen Brandes, Butler, Kephart, and Wood NOES: Mayor Mercer ABSEnt: None After further discussion, it was moved by Councilmember Wood, and seconded by Councilmember Butler, that Ordinance No. 875, modifying Ordinance No. 874 by changing the category of "Automotive Sales and Service!' in the CR(P) District from conditionally perm~itted to a permitted use, be introduced. Mayor Mercer reconvened the meeting at 11:00 P.M. ~TTERS CONTINUED FOR DECISION Annexation 73, 13.6 Acres on the North Side of Stanley Boulevard Continued from 11-14-78) Mr. Harris presented his report dated November 7, 1978, regarding this matter, and stated it had been continued from the meeting of November 14, 1978, at the request of the applicant, Joseph ~dden. Mayor Mercer declared the public hearing open. Mr. William Nirst, Attorney representing the applicant, urged Council to follow staff's recommendation to file application with LAFCO for annexation of all of the unincorporated County territory on both sides of Stanley Boulevard between Main Street and First Street. Mr. Earl Augusta, 3963 Stanley Boulevard, stated he was not opposed to annexation but wanted to be sure his property would be zoned residential rather than commercial. He further stated he felt all of the affected property owners in the unincorporated area should be polled regarding annexation, and that their choice regarding this matter should be honored.
