357 <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed. <br /> <br /> Councilmember Brandes stated he personally believed the developer would make <br />all changes necessary to eliminate the concerns of Council and the residents in <br />the affected area. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />that Resolution No. 78-300, denying the appeal of the City Council to design review <br />of the Van Bokkelen-Cole proposed shopping center project, and adding the following <br />three conditions to those previously established by the Planning Commission: (1) <br />that a 6' high masonry wall be constructed the entire length of the property line <br />where the existing fence is now located, including removal of the existing fence; <br />(2)' that the repair and maintenance of the wall and any damages caused by erosion <br />or slippage be the responsibility of the developer; and (3) that the Holding Tanks <br />be designed so that they will be pumped out from the western end of Building A, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, and Kephart <br />NOES: Councilman Wood and Mayor Mercer <br />ABSENT: None <br /> <br /> Prior to the vote Mayor Mercer asked Councilmember Brandes if he would be <br />willing to amend his motion to include two additional conditions as follows: <br />(!) that the t!olding Tanks be emptied during day time hours; and (2) that the <br />masonry fence be 8' high instead of 6' high. Councilmember Brandes stated he <br />would not amend his motion accordingly. <br /> <br />Application of Dr. Joseph Elia to rezone a two-acre parcel of land located on the <br />south side of Black Avenue approximately 400 feet west of Cedarwood Lane from the <br />P (Public and Institutional) District to the O (Office) District <br /> Mr. I~rris presented his report dated November 29, 1978, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Mr. Jack Bras, Architect representing Dr. Joseph Elia, stated his client con- <br />curred with the staff report and Planning Commission recommendations. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, that <br />Ordinance No. 873, to be read by title only and waiving further reading thereof, <br />tc rezone a two-acre parcel of land located on the south side of Black Avenue <br />approximately 400 feet west of Cedarwood Lane from the P (Public and Institutional) <br />District to the 0 (Office) District, and amending the Zoning Map of the City of <br />Pleasanton accordingly, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> 4. 12/5/78 <br /> <br /> <br />
