3.55 <br /> <br /> MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Chair. <br /> <br /> PUBLIC HEARINGS <br /> A_ppeal_ of the C~ty Council...to Design Review of Van Bokkelen-Cole <br /> Mr. Harris presented his report dated November 29, 1978, regarding this <br /> matter. <br /> <br /> Mayor Mercer stated this appeal had been initiated because of concerns on <br /> the design review relative to the buffer wall at the rear of the proposed center. <br /> <br /> ~yor Mercer declared the public hearing open. <br /> <br /> The following persons spoke in favor of the appeal: <br /> <br /> Fern Millard, 3160 Weymouth Court <br /> Willia, Kovan, 3124 Weymouth Court <br /> Mrs. I. Yssels, 3178 Weymouth Court <br /> Bill Vigil, 3432 Beecham Court <br /> <br /> The following person spoke in opposition to the appeal: <br /> <br /> Mr. Glenn Moore, representing Van Bokkelen-Cole, stated his client had agreed <br /> to the 33 items in the Conditional Use Permit and were willing to erect a 6' high <br /> masonry block fence replace the existing wood fence. He stated the fence would <br /> be built so that there would be no drainage or erosion problems. <br /> <br /> Council discussion ensued regarding location of the fence, responsibility for <br /> maintenance of the fence, and drainage and erosion control. <br /> <br /> Council inquired as to ~hat was proposed to be placed on the southeast corner <br /> of the complex. Mr. Moore advised this would be the location of the underground <br /> Holding Tanks. Mr. Moore stated that at such time as the Holding Tanks ~ere no <br /> longer needed they would be sealed and the area used as open space. <br /> <br /> Mr. Moore advised there would be low level security lighting around the rear <br /> perimeter for the protection of the residents on Weymouth Court. <br /> <br /> ~!r. Dick Fisher, Architect for the proposed center and resident of Pleasanton, <br /> explained the erection of the block wall and elimination of soil erosion and <br /> drainage problems. <br /> <br /> Mr. C. Yssels, 3~78 Weymouth Court, asked how keep the footing would be for <br /> the fence. Mr. Fisher advised it would be as deep as necessary relative to soil <br /> conditions. <br /> <br /> Mr. William Kovac, 3124 We)~outh Court, asked what time of day or night would <br /> tha Holding Tanks be pumped out and what noise would be created by this operation. <br /> Staff advised that the Itolding Tanks would have to be pumped out during the day- <br /> time hours because of a new agreement negotiated with Tri-Valley Pumping Company <br />--.- to dump effluent at the Sunol Treatment Plant, and that any noise problem was <br /> taken care of in the Environmental Impact Report. <br /> <br /> Mrs. I. Yssels, 3178 Weymouth Court, requested the fence be constructed on the <br /> homeowners side of the property line. Mr. Moore stated his client would need <br /> permission from all the home owners abutting the property line before building <br /> the wall.. <br /> <br /> 3. 12/5/78 <br /> <br /> <br />
