277. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> fter discussion, Council concluded that the piece of property is not needed <br />for present or prospective public street purposes, and that an order shall be <br />made vacating the public easement in the subject portion of the street and re- <br />turning the title of the land to the previous owner. <br /> <br /> it was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />that Resolution No. 78-267, ordering the vacation of that portion of Northway <br />Road, more particularly described on Exhibit A and shown on Exhibit B attached <br />to the report of the City Attorney dated October 5, 1978, and authorizing the <br />appropriate City officials to quit claim said property to Morrison Homes, a <br />Delaware Corporation, be adopted. <br />The ~ call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, and Mayor Mercer <br />NOES: ' None <br />ABSENT: Councilman Wood <br /> <br />~.b~TTLRS CONTIN1ED FOR DECISION <br /> There were no matters continued for decision presented at this meeting. <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br /> l-~yor Mercer recessed the meeting at 9:40 P.M. <br /> <br /> !~yor Mercer reconvened the meeting at 9:50 P.M. <br /> <br />REPORT~ OF BO.M{DS AN'O COMMISSIONS <br />Report of the Park and Recreation Commtssion} Re.: ~.ark Land In Lieu Fees <br /> l~yor Mercer reviewed the report of the City Attorney dated july 19, 1978, <br />and stzEed the Park and Recreation Commission concurred with the conclusions <br />and reconnnendations of the City Attorney's report. <br /> <br /> After discussion, Council instructed the City Attorney to meet with the <br />Planning Commission and Park and Recreation department to prepare a study and <br />General Plan amendment to implement the report of the City Attorney regarding <br />Park Land In Lieu Fees. <br /> <br />REPORTS OF THE CITY MANAGER <br />Request of Oak Hill Homeowners Association to purchase a portion of Oak Hill <br />Park Land <br /> Mr. Brown presented his report dated October 4, 1978, regarding this matter. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Kephart, that the request of Oak Hill Homeowners Association to <br />purchase a portion of Oak Hill park land be referred to the Park and Recreation <br />Commission for further review and a recommendation for Council action. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilman Wood <br /> <br /> 7. io/io/78 <br /> <br /> <br />
