concern that the study requested by Council might in some way jeopardize the <br />recently approved new housing for Komandorski Village. She questioned Council- <br />member Brandes' sincerity regarding public housing for low income. Councilmember <br />Brandes stated he had always been supportive of the Komandorski replacement and <br />would do nothing to endanger or delay the construction of this housing. Mrs. <br />Caughron stated she felt a meeting between City Council, the Housing Authority <br />Board, and the Tenants Association should take place to allow tenant input before <br />any decision is made regarding the study which is to be reviewed on September 12. <br /> <br />PUBLIC HEARINGS <br />~p~!ication of H. PUD ~evelopment plan approval withre~ard <br />to a fourteen acre site between Tawny and Palomino Drives immediately east of Pico <br />Avenue - six and nine-tenths acres is proposed for residential townhouse develop- <br />ment and seven and one-tenth acres is proposed as a neighborhood shopping center. <br />A negative declaration of environmental impact will also be considered <br /> Mr. Harris presented his report dated August 22, 1978, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> Gary Burn, representing H. C. Elliott, Inc., stated his client concurred with <br />the staff report and was agreeable to the conditions contained in the Planning <br />Commission resolution. <br /> <br /> Lewis ManSum, 872 Sylvaner Drive, stated he was not opposed to the application <br />but felt that the developer should correct the problems associated with his present <br />development before being allowed to start new construction. Mr. and Mrs. Mangum <br />stated that H. C. Elliott had violated the building code in the pouring of their <br />front steps, and they felt this and other faulty workmanship should be corrected <br />before approving any new application. <br /> <br /> The City Attorney advised that he did not believe the present application <br />could be held up but that the alleged Code violation should be investigated. <br /> <br /> Councilmember Brandes stated that a report had been requested from the City <br />Attorney regarding protection to the homebuyer against faulty worFmanship of a <br />developer or his subcontractor, and that it should be completed soon. Mr. Brandes <br />further stated he could not vote for any new H. C. Elliott development until they <br />had corrected the problems in their present development. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that the public hearing be continued open on the applica- <br />tion of H. C. Elliott, Inc., for PUD development plan approval with regard to a <br />fourteen acre site between Tawny and Palomino Drives ~mmediately east of Pico <br />Avenue - six and nine-tenths acres is proposed for residential townhouse develop- <br />ment and seven and one-tenth acres is proposed as a neighborhood shopping center, <br />and the negative declaration of environmental impact that will also be considered, <br />to October 3, 1978, 8:00 P.M., Pleasanton Council Chambers, for full Council <br />attendance, and report from the City Attorney regarding ways of protecting the <br />homeowner against faulty workmanship of the developer. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmen Kephart and Wood <br /> <br /> · 5. 8/29/78 <br /> <br /> <br />
