Councilmember Butler and Mayor Mercer abstained from voting on approval of <br />the City Council Minutes of July 25, 1978, due to their absence from that meeting. <br /> <br />~.IEETING OPEN TO THE PUBLIC <br /> Martin Inderbitzen, Attorney representing Vintage Hills Homeowners, requested <br />City Council vote of confidence and staff cooperation in litigation by the Vintage <br />Hills Homeo~ners against H. C. Elliott, Builder, and Texcoat, for the-deterioration <br />of exterior coating of homes in this area. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Kephart, to cooperate with the Vintage Hills Homeo~mers in their <br />litigation against H. C. Elliott, Builder, in whatever manner staff can, and that <br />documents that are necessary and useful in this suit be provided on request. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, BUtler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> After further discussion, Council instructed staff to prepare a report review- <br />ing possible methods of protection to the homebuyers against faulty workmanship <br />by a contractor or his subcontractors. <br /> <br /> Mr. Edwin C. Lamb, Valley Trails, expressed concern for the safety of children <br />walking to Donlon School now that bus service is being discontinued, and requested <br />Council to be aware of this situation and take whatever action is necessary to in- <br />sure the safety of children. He requested that a Councilmember attend School <br />Board meetings where this matter will be discussed. Councilmember Kephart, the <br />Council Traffic Liaison Member, stated he would attend any meetings relative to <br />this matter. <br /> <br />PUBLIC HEARINGS <br />Review of a neSative declaration to rezone an app.roximat.ely 1.1 acre parcel of <br />land located at the northwest corner of Johnson Industrial Drive and Hopyard Road, <br />from the I-G (General Industrial) District to the C-C (Central Commercial) District, <br />or any other zoning district consistent with the General Plan <br /> <br />Application of }Erris Realty to rezone an approximately 1.1 acre parcel of land at <br />the northwest corner of Johnson Industrial Drive and Hopyard Road~ from the I-G <br />(General Industrial) District to the C-C (Central Commercial) Distric, t..~..or any <br />other zonin~ district consistent with the General Plan <br /> ~. Harris presented his report dated August 2, 1978, regarding these two items. <br /> <br /> Mayor Mercer declared the public hearing open on the negative declaration and <br />the application. <br /> <br /> I.lr. Mike Harris, representing Harris Realty, stated he concurred with the <br />staff report and urged favorable consideration of the rezoning request. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed on the negative declaration and the application. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember ~od, that Resolution No. 78-198, denying the application of Harris <br />Realty to rezone an approximately 1.1 acre parcel of land at the northwest corner <br />of Johnson Industrial Drive and Hopyard Road, from the I-G (General Industrial) <br />District to the C-C (Central Commercial) District, or any other zoning district <br />consistent with the General Plan, be adopted. <br /> <br /> 2. 8/8/78 <br /> <br /> <br />
