After discussion, it was moved by Councilmember Wood, and seconded by <br />Councilmember Kephart, that Resolution No. 78-190, confirming weed abatement <br />cost accounting for 1978, with the exception of Parcels 164, 165, and 166, <br />protested to by Art Dunkley, and instructing the Treasurer-Tax Collector to <br />add these costs as a lien upon the parcel of property on the next regular tax <br />bill for each parcel, be adopted. <br />The roll call vote was as follows: <br />AYES:. Councilmen K~phart, Wood, and Vice Mayor Brandes <br />NOES: None <br />ABSENT: Councilman Butler and Mayor Mercer <br /> <br /> The City Attorney advised he would have a report regarding Mr. Dunkley's <br />Parcels 164, 165 and 166, for review at the Council meeting of August 8, 1978. <br /> <br />Opinion of Use of Park Dedication Fees <br /> Mr. Levine presented his report dated July 19, 1978, regarding this matter, <br />and recommended the item be continued to the meeting of August 29, 1978, for <br />full Council attendance. Council concurred. <br /> <br />Liab.tl~ty for Volunteers <br /> Mr. Levine presented his report regarding this matter. He stated that the <br />proposal submitted by Councilmember I~od for support of extending statutory <br />~mmunity to volunteers was basically sound and fair. He was concerned that the <br />City only indemnify volunteers if they were acting in this same capacity and <br />under the same circumstances as employees of the City. <br /> <br /> It was moved by Councilmember Wood, and seconded by Vice Mayor Brandes, that <br />Resolution No. 78-191, that the City propose and support the extension by the <br />State legislature or statutory immunity to officially sanctioned volunteers and <br />that such volunteers be indemnified to the same extent public employees would <br />be in this situation, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Keptmrt, Wood, and Vice ~yor Brandes <br />NOES: None <br />ABSENT: Councilman Butler and Mayor Mercer <br /> <br />Approval of Agreement between City and R. L. ,.K~.Rtz~ Re: Self-Insurance Adminis- <br />trative Services <br /> Mr. Levine explained the Agreement in detail. <br /> <br /> Councilmember Wood asked if the Agreement included an Errors and Omissions <br />clause. After discussion, Mr. Levine advised he would have a further report at <br />the meeting of August 8, 1978, regarding insurance coverage of R. L. Kautz and <br />the procedure for authorizing extraordinary payments. In addition, Jim Walker <br />would have a report on procedural matters related to the self-insurance program. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Wood, <br />that Resolution No. 78-191, approving the Agreement between the City and R. L. <br />Kautz for self-insurance administrative services, and authorizing the appropriate <br />City officials to execute the Agreement, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Kephart, Wood, and Vice Mayor Brandes <br />NOES: None <br />ABSENT: Councilman Butler and Mayor Mercer <br /> <br /> 7. 7/25/78 <br /> <br /> <br />
