Adoption of Ordinance No. 858, amending Subsection 2-9.19(1) (More Than one <br /> Use of a Site) and Section 2-9.23 (Designation of Off-Street Parking Facilities) <br /> of Article 16 (Off-Street Parking), Chapter 2 (Zoning), Title II (Zoning and <br /> Development) of the Ordinance Code of the City of Pleasanton relating to Park- <br /> ing Facilities. <br /> <br /> c. Adoption of Resolution No. 78-186, approving Final Map and Improvement Plans <br /> for Tract 3889, Mission Park, Unit No. 6, Beratlis-Byrd Enterprises, Inc., and <br /> approving the payment of park fees at the time of pa)~ent of building permit <br /> fees. <br /> <br />d. Open from 6-13-78 and 7-11-78) <br /> Vice }.Iayor Brandes declared this item continued open to the meeting of September <br /> 12, 1978, 8:00 P.M., Pleasanton Council Chambers, at the request of the appellant. <br /> <br />Appea~ of Harry Hemp~ to a decision of the Board of Ad~us. tme~t denyin~ ~ip applica- <br />tion for a Variance from the requirements of the Ordinance Code of the City of <br />Pleasanton to allow the reparcelization of approximately 12.5 acres of land lo- <br />cated on the west side of Foothill Road near its intersection with Highland Oaks <br />Drive <br /> Mr. Harris presented his report dated July 18, 1978, regarding this matter. <br /> <br /> Vice Mayor Brandes declared the public hearing open. <br /> <br /> Mr. Gilbert Barbee, 147 Bernal Avenue, representing Harry Hempy, requested this <br />item be continued for full Council attendance. After discussion, Mr. Barbee with- <br />drew his request for continuance. <br /> <br /> Mr. Barbee displayed a map showing configuration of the three lots involved and <br />a proposed reconfiguration that he felt would be a better arrangement. Mr. Barbee <br />stated that the City had not required Mr. Hempy to have a survey made when his <br />house was built in 1969, therefore, he did not feel that Mr. Hempy should be <br />penalized because the house straddled an existing property line.
