Councilmember Mercer asked about the status of clean up of the Zone 7 canal. <br />Mr. Brown advised that City crews had picked up some of the litter and would con- <br />tinue to do so. Councilmember ~ercer stated he felt this was the responsibility <br />of Zone 7 for clean up. He requested that'theMayor write a letter to Zone 7 <br />relative to their responsibility of the Canal clean up. Council concurred. <br /> <br /> Councilmember Wood inquired as to the status of the report regarding CC&R's. <br />The City Attorney advised that it had not been prepared and at this time he did <br />not know when it ~ould be completed. <br /> <br /> Councilmember Wood inquired about the status of the fence repair behind the <br />Safeway Shopping Center. Mr. Brown advised that the area was being cleaned up <br />and the fence repaired with an opening in the fence for pedestrian pass through. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> There were no City Council Committee Reports presented at this meeting. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Chair. <br /> <br />PUBLIC HEARINGS <br />Consider the adoption of additional weight limitations on several streets in the <br />City of Pleasanton, .including Sunol Boulevard and First Street <br /> Mr. Brown presented his report dated June 4, 1979, regarding this matter. He <br />stated that in 1972 the City Council was considering a weight limitation ordinance <br />which would have prohibited thru-truck traffic, but apparently in an effort to <br />avoid costly litigation for both sides, the gravel producers entered into an <br />agreement and the City did not prohibit truck traffic on First Street and Sunol <br />Boulevard. Mr. Brown stated the recommendation to be considered tonight is that <br />the Council adopt a resolution serving notice of termination of the agreement to <br />the gravel producers. The terms of the agreement require a 90 day notice which <br />means the termination date would be approximately September 11, 1979. Mr. Brown <br />listed the grounds for termination as follows: (1) that unforeseen circumstances <br />have arisen that justify unilateral termination, these circumstances include <br />dramatic increases in truck traffic, increased traffic congestion, more noise, <br />dust and traffic hazards and continual and substantial damage to City streets; and <br />(2) the 1972 agreement has an implied five year term which has expired. Mr. Broken <br />stated the second reconunendation before the Council is that a truck weight limita- <br />tion ordinance be approved that would prohibit all vehicles in excess of 16,000 <br />pounds GVW, but exempting Lone Star Industries for a period of three years to allow <br />them time to secure an alternate route. Mr. Broom stated that relative to the <br />number of gravel trucks using First Street and Sunol Boulevard, as shown in the <br />staff report the number of trucks has increased at least 80 percent since 1972 and <br />perhaps as much as 188 percent. These estimates are based on the available data <br />from 1972, 1975 and from actual counts taken in March and May of 1979. He added <br />that it is readily apparent that the number of trucks has increased dramatically. <br /> <br /> Mayor Brandes declared the public hearing open, and requested those persons <br />in favor of the truck ban ordinance to speak first. <br /> <br /> Mr. Ray Goluba, 5640 Paseo Navarro, representing the Pleasanton Join't School <br />Board of Trustees, presented a letter from Mr. William Berck, Superintendent, dated <br />June 8, 1979, which read as follows: <br /> <br /> "The Board of Trustees of the Pleasanton Joint School District is aware <br /> of the current citizens' concerns regarding traffic on First Street. The <br /> Board has been apprised of recent decibal measurement at the Pleasanton School <br /> Site and its implications regarding noise levels that are being exceeded. <br /> <br /> 2. 6/12/79 <br /> <br /> <br />
