<br />approving by motion the report of the Director of Public Works and Utilities, dated
<br />May 1, 1979, stating that if the County wishes to expand the County Service Area to
<br />include Castlewood Water and Sewer Services, and maintain these systems, the City has
<br />no objection.

<br />R.equest for Annexation of Froman Property
<br />Mr. Brown presented his report dated May 2, 1979, regarding this matter.
<br />
<br /> Mr. Loube, Attorney, 1805 Harrison Street, Oakland, representing Mr. Fromm, stated
<br />he felt the results of annexing this property to the City would be extremely beneficial
<br />to the community and he requested a guarantee of sewer capacity for development of this
<br />land. Staff stated the City could not guarantee any sewer capacity at this time but
<br />could proceed-with the preparation of a draft annexation agreement for negotiation.
<br />
<br /> Mr. Ted Fairfield, Civil Engineer, stated the property owner would like to get
<br />formal annexation proceedings started as soon as possible.
<br />
<br /> Mr. Henry }.~riani, Attorney representing Willow West Properties, stated his client
<br />concurred with the report of the City ~.~nager, dated May 2, 1979, and added he felt it
<br />would be a serious mistake for the City to enter into any agreement to guarantee sewer
<br />capacity for someone coming into the City as a condition to annexation.

<br />cate its willingness to annex the Fromm property and that the y s annexation of the
<br />property does not guarantee or assure the availability of sewage treatment capacity,
<br />that should the City Council or Mr Fromm desire a formal annexation agreement staff
<br />should be directed to negotiate a draft of such an agreement for future consideration
<br />by the Council, and that if an annexation agreement is pursued it should be made clear
<br />that the City is specifically interested in the completion of Valley Avenue to Bernal
<br />Avenue and the City is unable to make firm commitments or assurance of sewage treatment
<br />capacity beyond cooperation and good faith efforts.

<br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council-
<br />member Kephart, that Resolution No. 79-82, approving contract between Albert S. Dutch-
<br />over, Landscape Architect, and the City, for architectural services for Youth Sports
<br />Park, Phase III, and authorizing the appropriate City officials to execute the Agree-
<br />ment, be adopted.
