First, it was an administrative rather than <br /> legislative act, and second, the subject of grade separations was a matter of state- <br /> wide concern within the purview of the Public Utilities Commission and California <br /> Highway Commission. Such matters are not subject to referendum. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that <br /> Resolution Mo. 79-80, declaring that Resolution No. 79-47 was not a proper subject of <br /> referendum and therefore no special election should be called, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Butler, Kephart, and Mayor Brandes <br /> NOES: Councilman Mercer <br /> ABSENT: None <br /> ABSTAINED:Councilman Wood <br /> <br /> 5. 5/8/79 <br /> <br /> <br />
