Mr. Harris presented his report dated March 7, 1979, regarding these two items. <br /> <br /> The City Attorney presented a draft resolution modifying Conditions 4 and 5 of <br />the Design Review Board relative to this matter. <br /> <br /> .Mayor Brandes declared the public hearing on these two items open. <br /> <br /> Mr. Brad Hirst,. appellant, stated he was agreeable to the two conditions as <br />modified in the draft resolution providing Condition 4 could be handled at staff <br />level thereby eliminating any further delay of the project. Staff advised this <br />was acceptable. <br /> <br /> There being no further public testimony, Mayor Brandes declared the public <br />hearing closed on these two items. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br />Councilmember Kephart, that the wording "Home of the Whopper" not be allowed <br />on the Burger King sign, since this location is at the entrance to the City. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and },~yor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Wood, <br />that Resolution No. 79-36, regarding appeal of Z-79-11; appeal of Brad Hirst to <br />the decision of the Design Review Board prohibiting egress onto Hopyard Road <br />from the Burger King Restaurant proposed to be located approximately 700 feet <br />south of 1-580 on the east side of Hopyard Road, and appeal of the City Council <br />of a decision of the Design Review Board approving the'design of a Burger King <br />Restaurant proposed to be constructed on the east side of Hopyard Road approxi- <br />mately 700 feet south of 1-580, modifying Conditions 4 and 5 of the Design Re- <br />view Board, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />REPORTS OF THE CITY MANAGER <br />R~quests for Connection to Sewer System: Remen Tract Area and Happy Valley Area <br /> Mr. Campbell presented his report dated March 7, 1979, regarding this matter. <br />He also presented two letters; one from Alameda County Health Department dated <br />March 7, 1979, recommending connection of 6248 Amber Lane, Happy Valley area, to <br />public sewerage treatment system as soon as possible, and one from Mr. and Mrs. <br />Kenneth Henkelman, owners of property on Linden Way, Remen Tract, requesting to <br />be annexed into the City. <br /> <br /> Council determined to consider each tract area separately. <br /> <br />}[appy Valley Area <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br />Councilmember Butler, that the property of ~fr.
