Councilmember Brandes stated that while he did not disagree with the action <br />taken by the Planning Commission on this item he was concerned that this use <br />should be a conditional use rather than a permitted use and evaluated periodi- <br />cally. <br /> <br /> Mayor Mercer declared the public hearing open. <br /> <br /> No one spoke in favor of the appeal. <br /> <br /> The following persons spoke in opposition to the appeal: <br /> <br /> Johanna Kachler, owner of La Femme Beauty Salon <br /> James C. Wharton, Attorney, 6990 Village Parkway, Dublin, presented <br /> a letter to the City Council dated January 9, 1979, <br /> explaining the business activities of the beauty <br /> salon. <br /> Shirley Hardy, 6034 Alisal <br /> Glenna Wilfley, 4098 Wells Street <br /> Betty Rider, 4393 Miradot Drive <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Kephart, <br />that the appeal by the City Council of a decision of the Planning Commission <br />making the determination that the emplo)~ent of one masseuse as ~ p~rt of the <br />La Femme Coiffeurs Beauty Salon at 6027 West Las Positas Bouelvard does not change <br />the characteristic of that business and that it will continue to be considered a <br />beauty shop for the purposes of the Ordinance Code of the City of Pleasanton, <br />be approved. <br /> <br /> Council discussion ensued regarding the possibility of changing masseuse <br />activity as a conditional use with a beauty shop, and the length of time in <br />which this category change could become effective. <br /> <br /> After further discussion, Councilmember Brandes withdrew his motion and <br />Councilmember Kephart withdrew his second. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, <br />that Resolution No. 79-6, denying the appeal by the City Council of a decision <br />of the Planning Commission making the determination that the employment of one <br />masseuse as a part of the La Fenme Coiffeurs Beauty Salon at 6027 West Las <br />Positas Boulevard does not change the characteristic of that business and that <br />it will continue to be considered a beauty shop for the purposes of the Ordi- <br />nance Code of the City of Pleasanton, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Application of the City Council for an amendment to Section 2-7.08(a) of Article <br />8~ Chapter 2~. Title II of the Ordinanc.e Code qf. the City of Pleasanton which <br />would revise compr. eh.e.n. sively the schedule of permitted and conditional uses in <br />all of the commeFcially zoned districts except the CR(M) and CR(P) Districts of <br />the City of Pleasanton <br />(Continued Open from 11-14-78 and 12-5-78) <br /> Mr. Harris presented his report dated January 3, 1979, regarding this matter. <br /> <br /> 6. 1/'9/79 <br /> <br /> <br />
