Councilmember Brandes stated that while he did not disagree with the action taken by the Planning Commission on this item he was concerned that this use should be a conditional use rather than a permitted use and evaluated periodi- cally. Mayor Mercer declared the public hearing open. No one spoke in favor of the appeal. The following persons spoke in opposition to the appeal: Johanna Kachler, owner of La Femme Beauty Salon James C. Wharton, Attorney, 6990 Village Parkway, Dublin, presented a letter to the City Council dated January 9, 1979, explaining the business activities of the beauty salon. Shirley Hardy, 6034 Alisal Glenna Wilfley, 4098 Wells Street Betty Rider, 4393 Miradot Drive There being no further public testimony, Mayor Mercer declared the public hearing closed. It was moved by Councilmember Brandes, and seconded by Councilmember Kephart, that the appeal by the City Council of a decision of the Planning Commission making the determination that the emplo)~ent of one masseuse as ~ p~rt of the La Femme Coiffeurs Beauty Salon at 6027 West Las Positas Bouelvard does not change the characteristic of that business and that it will continue to be considered a beauty shop for the purposes of the Ordinance Code of the City of Pleasanton, be approved. Council discussion ensued regarding the possibility of changing masseuse activity as a conditional use with a beauty shop, and the length of time in which this category change could become effective. After further discussion, Councilmember Brandes withdrew his motion and Councilmember Kephart withdrew his second. It was moved by Councilmember Wood, and seconded by Councilmember Butler, that Resolution No. 79-6, denying the appeal by the City Council of a decision of the Planning Commission making the determination that the employment of one masseuse as a part of the La Fenme Coiffeurs Beauty Salon at 6027 West Las Positas Boulevard does not change the characteristic of that business and that it will continue to be considered a beauty shop for the purposes of the Ordi- nance Code of the City of Pleasanton, be adopted.
