Fire Protection Services to Unincorporated Areas <br /> Mr. Walker presented his report dated October 31, 1979, regarding this matter. <br /> <br /> Councilmember Mercer asked what guarantee the City had that this contract would <br />not be cancelled later on. Mr. Walker advised there was no guarantee. <br /> <br /> Councilmember Kephart asked if the City could charge for response service if <br />the contract is cancelled. Mr. Walker advised the City could not charge under <br />Mutual Aid response. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that <br />Resolution No. 7~-229, approving the Modification of Contract to extend the agreement <br />to provide fire protection to the four County areas of Remen Tract, Castlewood, ~ppy <br />V'alley and Stanley Boulevard, until December 31, 1979, for $27,038.50, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />Matters for the Information of the Council <br />Mr. Brown advised that he, Mr. Harris, Mr. Walker, and Councilmember Wood, had <br />met this date with representatives of Kaiser Sand and Gravel regarding the opening <br />of E1 Charro Road for commercial/industrial use. He stated that Kaiser was not <br />responsive because of potential litigation relative to First Street truck traffic. <br />He added that Kaiser is not interested in allowing E1 Charro Road becoming a public <br />road until they are through with their mining operations in approximately 20-30 years. <br /> <br /> Mr. Brown presented the Information Report of the Director of Planning and Com- <br />munity Development dated November 6, 1979, regarding proposal for citizen participa- <br />tion in the Housing Element Revision. It was moved by Councilmember Mercer, and <br />seconded by Mayor Brandes, that no one be excluded that desires to participate in <br />the housing element revision study. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> Mr. Brown presented the Information Report of the Director of Recreation and <br />Human Resources dated October 30, 1979, regarding Special Projects Title VI, <br />Pleasanton Downtown Association Projects, stating this application was an unfor- <br />tunate victim of enforcement of federal regulations. <br /> <br />REPORTS OF THE ~ITYiATTORNEY <br />Agreement with Pleasanton Cultural Arts Council <br /> Mayor Brandes declared this item continued to the meeting of November 27, 1979. <br /> <br />Oral R~port Regarding Financial Liability for In3ury caused by hazardous construction <br />and Signing on 1-580 <br /> The City Attorney advised that it would be highly remote that the City would be <br />held financially liable for injury caused by hazardous construction conditions and <br />signing on 1-580, even if the City agreed to the modified plan proposed by the State <br />and the Sierra Club. <br /> <br />COMMUNICATIONS <br />Councilmember Mercer stated that he and Mayor Brandes had met with Senator <br />Holmdahl and other agencies and interested parties regarding modifications in the <br /> <br /> 15. 11/13/79 <br /> <br /> <br />
