Mayor Brandes reminded everyone that this application is only for consideration <br /> of the rezoning application, and not for a development plan. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br /> Negative Declaration. <br /> <br /> Mr. William Hirst, 147 Bernal Avenue, representing the applicant, stated this <br />property had recently had a General Plan amendment to clarify the Urbanization Line <br />on the property. He reviewed the process to fezone this parcel to HPD District <br />rather than PUD asfirst requested. Mr. Hirst reviewed the reasons for requiring <br />a mitigated Negative Declaration, and presented a geotechnical report prepared by <br />Judd Hall, as well as other reports, elaborating on soil conditions. Mr. Hirst <br />stated that any environmental concerns could be addressed at the precise develop- <br />ment plan stage. <br /> <br /> Mr. Ed McGovern, 9206 Longview, stated he opposed the application because of <br />long term development density which he felt would be increased. He also felt an <br />Environmental Impact Report should be required as this parcel is on an active <br />slide and because the northeast corner lies on the Calavares Fault zone. He <br />stated he was concerned about the impact of 36 homes proposed to be constructed. <br /> <br /> Discussion ensued regarding density on Hillside Planned Development districts. <br />Mr. Harris stated that the slope of this property is right at 25% or slightly <br />higher which would mean an average density of one unit per five acres. <br /> <br /> Mr. John Innes, 1586 Foothill Road, expressed confusion over the intent of <br />the application and expressed concern regarding the number of units to be built <br />on the property. He stated he preferred to area remain Agriculture as he felt <br />development would increase once it was started. The City Attorney advised that <br />Agricultural zoning allowed residential development of one unit to five acres. <br /> <br /> Mr. Hirst rebutted the concerns of the opponents stating the property would <br />be low density and subject to the appropriate soils conditions. <br /> <br /> -There being no further testimony, Mayor Brandes declared the public hearing <br />closed on the application and the Negative Declaration. <br /> <br /> Council discussion ensued regarding environmental concerns and the appropriate <br />time to require an Environmental Impact Report if it was determined that one would <br />be required. The City Attorney advised that if it is determined that an Environ- <br />mental Impact Report be prepared it should be done at the earliest possible time <br />but not necessarily at the earliest approval stage. Me stated that since Council <br />at this time had no idea what the project will be like it will be difficult to get <br />a complete Environmental impact Report until the development plan approval stage. <br /> <br /> After further discussion, it was moved by Councilmember Butler, and seconded <br />by Councilmember Mercer, that Resolution No. 79-172, determining. on the basis of <br />a review of initial environmental study done for this project, that no significant <br />environmental impact would occur as outlined in the City's guidelines and that a <br />Negative Delcaration is appropriate to fezone to HPD (Hillside Planned Development) <br />District the 73 acre site located west of Foothill Road and north of Longview Drive, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> 5. 9/18/79 <br /> <br /> <br />
