vides for simplified methods of notification consistent with the limits of the <br />First Amendment as defined by the California Supreme Court. <br /> <br /> Mr. Gerry Hallstrom, General Manager of the Valley Times, stated his newspaper <br />has controlled circulation and it only requires a telephone call to stop delivery. <br />He indicated that he believed people should be able to stop delivery of his paper. <br /> <br /> Councilmember Butler asked if it were possible to include telephone notifica- <br />tion as well as signing or symbol. The City Attorney said yes, and revised the <br />draft ordinance to include telephone notice. <br /> <br /> It was moved by Mayor Brandes, and seconded by Councilmember Kephart, that <br />Ordinance No. 904 be read by title only and waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Kephart, and seconded by Mayor Brandes, that <br />Ordinance No. 904, amending Article 8, Chapter 2, of Title IV of the Ordinance <br />Code of the City of Pleasanton by adding Subsection 4-3.50(e) relating to un- <br />solicited newspapers, as revised by Council at this meeting, and requesting staff <br />to recommend a specific symbol for notice to carriers, be introduced, with the <br />second reading and adoption to be considered at the City Council meeting of <br />October 23, 1979, to allow the newspapers and other interested persons to review <br />the ordinance. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and Mayor Brandes <br />NOES: Councilman Mercer <br />ABSENT: None <br /> <br />Annexation No. 78 (Fromm Propert7) <br /> Mr. Brown presented the report of the Director of Public Works and Utilities <br />dated August 30, 1979, regarding this matter. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Mayor Brandes, that <br />Resolution No. 79-166, making application to Alameda County Local Agency Forma- <br />tion Commission requesting initiation of proceedings for proposed Annexation No. <br />78 (Fromm Property), pursuant to the Municipal Organization Act of 1977, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />~punty Government Center and Jail Fa~lity <br /> Mr. Brown presented his report dated August 27, 1979, regarding this matter. <br /> <br /> Mayor Brandes stated he felt the present Jail facility was a discredit to the <br />County and the community. He stated he was disappointed in the action of the <br />Supervisors in not allowing the voice of the City on the Justice Council, as there <br />are other elected officials on this body. <br /> <br /> Councilmember Kephart stated that while he appreciated his appointment on the <br />Post-Sentence Advisory Committee, this group did not cover the concerns of the <br />City relative of jail facilities.
