~peal of Robert PearsOn, et al, of a decision of the City Plannin~ Commission <br />~anting a conditional use permit for limited warehousing purposes at 3701-23 <br />Old Sanua Rita Road (UP-79-15) <br /> Mr. Harris presented his report dated August 13, 1979, regarding this matter. <br /> <br /> Mayor Brandes declared the public bearing open. <br /> <br /> Mr. Robert M. Pearson, 3590 Churchill Court, stated he appealed this'matter <br />because of the 26 homes that back up to Santa Rita Road and he felt this applica- <br />tion would increase truck traffic which would threaten the health, safety and wel- <br />fare of these people. He reviewed the background of the commercial development as <br />well as truck traffic in this area, and urged the Council not to grant any additional <br />permits for uses that would increase truck traffic until such time as a frontage road <br />is constructed for proper access to the commercial area. <br /> <br /> Mr. Lowell Beasley, 3673 Cambridge Court, stated he concurred with Mr. Pearson <br />in opposing any increase of truck traffic on Santa Rita Road. <br /> <br /> The following persons spoke in opposition to this appeal: <br /> <br /> Mr. Joe Madden, 3851 Vineyard Avenue, owner of the warehouses, stated he con- <br />curred with the staff report. He stated the 3 use permits would generate no more <br />than 10 truck trips per day which he felt was insignificant. Mr. Madden presented <br />a letter from one of the proposed lessors, Kilpatrick's Bakeries, Inc., dated <br />August 23, 1979., requesting no more delays, and urging immediate approval of the <br />permits. <br /> <br /> Mr. Brad Hirst, 2456 Minivet Court, stated that Santa Rita Road had been <br />planned for years as a major arterial road into Pleasanton and that there will <br />be increased truck traffic on this street. He stated that to be concerned about <br />an additional 10 trucks per day that this permit would generate was redundant. <br /> <br /> Mr. Robert Pearson rebutted that Santa Rita Road is a threat to the 26 homes <br />that back up to this street; that the value of property is also affected; and <br />that something should be done to alleviate the problem. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed. <br /> <br /> Mr. Harris advised that truck traffic was already assessed when the.Negative ' <br />Declaration was prepared for this project and it was determined that an increase <br />of 10 trucks per day would not adversely impact the environment. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Butler, to deny the appeal of Robert Pearson, et al, of a decision of the <br />City Planning Commission granting a conditional use permit for limited warehousing <br />purposes at 3701-23 Old Santa Rita Road (UP-79-15). <br />The roll call vote was as follows: <br />AYES: Councilmen Butler and Mercer <br />NOES: Councilman Wood and Mayor Brandes <br />ABSENT: Councilman Kephart <br /> <br /> Mayor Brandes stated that due to the split vote he would declare the public <br />hearing reopened on this item and continued to the meeting of September 11, 1979, <br />8:00 P.M., at the Fairgrounds Cafeteria, for full Council attendance. <br /> <br /> 20. 8/28/79 <br /> <br /> <br />
