There being no further testimony, Mayor Brandes declared the public hearing <br /> closed on the application and the Negative Declaration. <br /> <br /> Mayor Brandes stated consideration should be given with regard to zoning if <br />Variences are going to be allowed since a majority of these parcels do not have <br />street frontages and would require a Varience. No further discussion ensued <br />relative to this matter. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Butler, <br />that Resolution No. 79-119, determining on the basis of a review of initial en- <br />vironmental study done for this project, that no significant environmental impact <br />would occur as outlined in the City's guidelines and that a Negative Declaration <br />is appropriate to prezone a 37 acre area located along Stanley Boulevard between <br />Main Street and First Street-Stanley Boulevard roadway as follows: that the Augusta <br />property and the Southern Pacific Railroad right-of-way be prezoned A (Agricultural); <br />that the Western Pacific Railroad property not be prezoned to any designation; that <br />the Madden property be left as it is (prezoned A); and that the remainder of the <br />subject area be prezoned R-i-20,000, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, and Mayor Brandes <br />NOES: None <br />ABSENT: Councilman Wood <br /> <br /> After further discussion, it was moved by Councilmember Mercer, and seconded <br />by Councilmember Butler, that Ordinance No. 898, to be read by title only and <br />waiving further reading thereof, to prezone a 37 acre area located along Stanley <br />Boulevard between Main Street and First Street-Stanley Boulevard roadway as <br />follows: that the Augusta property and the Southern Pacific Railroad right-of-way <br />be prezoned A (Agricultural); that the Western Pacific Railroad property not be <br />prezoned to any designation; that the ~dden property be left as it is (prezoned <br />A); and that the remainder of the subject area be prezoned R-i-20,000, be intro- <br />duced. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, and Mayor Brandes <br />NOES: None <br />ABSENT: Councilman Wood <br /> <br /> Mr. Augusta was advised of the possible time table regarding conformance of <br />his property to the General Plan and further prezoning procedures. <br /> <br />Review of V-79-10~ application by Robert Molinaro for a variance from the require- <br />ments of the code to allow the subdivision of a 46~000~sR. ft. lot located at <br />4189 Stanley Boulevard into four pa.rcels~ three of E~iqh would not have the re- <br />quired street frontage~ one of.~hich would not have the required lot width~ and... <br />one which would not have the required lot depth, zoning fo~...the .p.ropert.y is <br />R-1-6500 District <br /> Mayor Brandes stated he requested this item be reviewed by City Council to <br />determine if Variences are going to be allowed for homes not having street front- <br />age, and if this would set a precedent. <br /> <br /> Mr. Harris presented his report dated July 12, 1979, regarding this matter. <br /> Mayor Brandes declared the public hearing open. <br /> <br /> 5. 7/24/79 <br /> <br /> <br />
