Mr. Martin Inderbitzen, Attorney, 147 Bernal Avenue, representing Robert <br />Molinaro, stated his request for variences had been changed since the original <br />application and that now he had applied for a variance on 3 parcels which do <br />not have proper frontage. He stated he concurred with the staff report, that <br />the development did not change the life style of the area, and was a lesser <br />density than allowed under the Code. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br />Councilmember Butler, to uphold the decision of the Planning Commission approving <br />the application of Robert Molinaro for a variance from the requirements of the <br />code to allow the subdivision of a 46,000~ sq. ft. lot located at 4189 Stanley <br />Boulevard into four parcels, three of which would not have the required street <br />frontage, zoning for the property is R-1-6500 District. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler and Mercer <br />NOES: Councilman Kephart and Mayor Brandes <br />ABSENT: Councilman Wood <br /> <br /> Due to the split vote, Mayor Brandes declared the public hearing reopened on <br />this item and continued to the meeting of August 28, 1979, 7:30 P.M., at the <br />Fairgrounds Cafeteria, for full Council attendance. <br /> <br /> Mayor Brandes recessed the meeting at 9:15 P.M. <br /> <br /> Mayor Brandes reconvened the meeting at 9:25 P.M. <br /> <br />Appeal of Centex Homes to a decision of the Planning Commission deny.ing case PUD-79-1, <br />their application for a Planne~.Unit Development approval for a 116 unit,. single- <br />~amilX detached residential complex to be located on a 32.4 acre site located between <br />the Pleasanton School upper..playfield and Mirador Drive and immediately..s.outherly of <br />the residences borderin8 An~ela Street. The site is .preSently zoned A (A~ricUltural) <br />District <br /> <br />On the basis of an Initial Study of the ..potential environmental impacts of the <br />project~ the D.~rector of Planning and Community Development has determined that <br />the prop0~.e~ project would not ~ve any potential siSnificant adverse effects on <br />the environment and that an environmental impac. t report need not be prepared. This <br />Initial Study is available for review at the Plannin~,Di~.i.S.ion~ 200 Bernal Avenue, <br />Pleasanton. Comments on t~is decision ma7 be directed to either the Plannin~ s~aff <br />prioF to the above meeting date.~. or directly to the City Council at the above <br />noticed meetin~ <br /> Mr. Harris presented his report dated July 12, 1979, regarding this matter. He <br />stated this item had been before the Planning Commission on two occasions, and at <br />the last meeting the Planning Commission felt that there were problems with the <br />development so they denied the application, however it was denied without prejudice. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br />Negative Declaration. <br /> <br /> 6. 7/24/79 <br /> <br /> <br />
